    Unregulated parking companies can make up any rules they like and put up as many or as few signs as they like.

    If the road was private then the BB does not apply.
    The blue badge scheme does not apply on private land. The booklet that comes with the BB, the BB Gov website, and House of Commons Library all say this.

    Private parking companies target EVERYONE. It matters not if you are disabled or a war hero or driving a fire engine on a shout, they just don't care.

    Please, just follow the tried and tested process. Appeal using the template from post 1 of the NEWBIES.
    If/when it is rejected you go into ignore mode unless you get real court papers. This company are not particularly litigant hence the comment not to stress out.

    You can't counterclaim unless they take you to court, and it would need to be for something like a DPA breach or misuse of your data.
    I suggest you ask your solicitor family member about claiming against them for anything else.

  • Thanks fruitcake. There is no signage that the road is private, it is only since the incident that the driver has been told by someone who works nearby and finding a newspaper article from 3 yrs ago. So basically disabled drivers are meant to be mind readers, as well as the fact the driver was told it was ok to park there.
  • when writing to them should all the additional info be put on the letter too, such as everything we have been told so far about the signage being forbidding and not contractual, the £1.50 transaction fee being banned, no indication of leaving a public highway, the traffic warden, etc.?

    is this letter to them ok to be emailed using their email address, which is where the driver was told to send it thru via the receptionists in the nearest building who rang them?

    Just copy and paste and send the initial template from the NEWBIES as already advised, exactly as it is, by whatever method it tells you to use on the PCN.

    Send it from The Keeper around day 26 like the NEWBIES tells you to do.

    Read up in the NEWBIES on what to do next whilst you are waiting.

  • the pcn states to appeal within 21 days so leaving it til day 26 is already too late? it also asks for supporting evidence

    Sorry, I was getting mixed up with BPA members.

    Since this is an IPC member I believe the NEWBIES tells you to wait for the NTK. Double check that that is still the case.

    Once it arrives, you send the template exactly as it is from The Keeper by whatever method it tells you to use.

  • whats ntk and where do we double check? now we are confused as were advised elsewhere to wait til day 26 too with the knowledge it was ipc, what is the actual procedure that should be followed? thanks

    Acronyms are explained in the NEWBIES.

    The timing for when to appeal a BPA member windscreen ticket versus when to appeal an IPC member windscreen ticket is explained in the NEWBIES.

    From memory, the NEWBIES tells you that The Keeper should appeal the former around day 26 and the latter you should wait for the NTK. You need to check that for yourself in the NEWBIES to be sure I have given the correct information.
