Given Ticket after warden instructed driver to park with disabled disk

I hope someone can help.

The driver went for a market research interview for an hour in a section of Manchester that theyve never been to. Its fairly new.

They drove down the road first and saw double yellows, and some signs from a private parking company on boards round building sites along that road that it was no unauthorised parking. They turned the car round and looked out to ask someone where they could park. They saw a parking warden across the road and called him over. He said it was fine to park on the double yellows with disabled disks for 3 hrs. Which is what they did.

An hour later when they came out there was a ticket on the car from parking patrol. The driver was so stressed, upset and shaking.

They went over to some of the workmen to see if they saw the driver speaking to the warden, but they didnt, but they did say it sounded like he told them to park there so he could book them.

They then went into one of the venues in the area and they phoned the company and they said the driver should email in and they will sort it. The driver asked if there was cctv where they were and the man in the venue didnt think so.

They came home and phoned the company again, twice the company put the phone down cos they were so upset and panicking.

They rang back a third time and the company asked for a description of the warden and straight away said he wasnt one of theirs and he mustve been council. We tried to get thru to the council but had to leave a message.

There are no official signs on the road at all to state it is private. the parking signs which are set quite high up on the side the car was parked on and surrounded by graffiti.

We are drafting a letter to the landowners, but as they own the whole land and not any of the social premises on the land we cant threaten with not frequenting there again, weve explained exactly what happened and if theyre able to access cctv to prove the driver spoke to a warden and turned round and parked up straight after. but what else should we outline to them and what else should we do to appeal?

They are with IPC and it is already determined that the signs are forbidding.

They went to earn a little extra cash doing the research as over the last 12 mths theyve had a stream of cowboy builders ruin their home and take a massive amount of money and now on overspend getting the house put right and cant work, they also had brain surgery 18 mths ago of which there is a complication which gets worse when upset and stressed, so this fine and the worry that goes with it is the very last thing needed.

PLEASE HELP, in a hell of a state about this. Thank you in advance

    its difficult to compare other posts as the driver was told by a traffic warden/parking attendant to park where the car was and had disabled disks clearly showing and apparently it is a private road, even though there is no official sign saying so, just the parking signs. most people would trust a traffic wardens word for the correct places to park but without cctv theres no way of knowing if they were a council or parking company employee.

    NONE of the above matters, stop fixating on a pointless detail of the scam. It was probably the PPC's own employee setting you up for a fall.

    my boss used to work for a parking company and he has said it wouldnt matter if the police had said it was ok to park there, if the parking company are on that ground then we dont have a leg to stand on.
    What a nasty person to spin such utter twaddle at you.

    PLEASE stop trying to prove something you DO NOT need to prove, about some scammer setting her up for a fall by lying, like your nasty boss.
    they will get back to me in the next few days but they think it might have been the parking companies employee as their wardens wouldn't normally be walking across the area.
    Of course it was, I told you that on pepipoo...it was the scammer himself.

    Stop worrying and ignore them, and come back if ever they try a small claim.

    thanks for responding on here. do you know if the parking companies 'attendant' would have been in a uniform and what that uniform is? the driver remembers his face clearly.

    does it make a difference that there is no signage that it apparently is a private road?

    also does it make a difference that they seem to be targeting the disabled, as most people wouldnt park there anyway because it is double yellows, the only people who can legally park on doubles are those with disabled disks.

    we spoke to CAB today and they said not to leave it beyond the 21 days and to write to them to appeal. is this correct?

    we have spoken to a family member today who is a solicitor and they have said to write to the company to tell them to deal with him. is this the right thing to do?

    can a counter claim be made to them for the underhand methods/lie?

    why is there no need to stress over this company? it is certainly a very cruel act.

    I would suggest that as this solicitor is a family member, if
    he/she wants to help you before this explodes in your mind,
    that they come on this thread because there are 3 very
    well versed solicitors on this forum who he/she should
    converse with. Will he/she do that

    Are they going to charge you (even at family rates)? If so, don't bother. All the advice is free here, including from legally qualified people who are committed to, and fully understand all the issues related to, fighting private parking charges.

    Ask your sol relative what he knows about private parking charges. Does he think he is as informed (or even better informed) than those dealing with this stuff, literally 24/7/365?

    We are not dissing his offer, but if his knowledge is scant, he's not going to do you any favours - regardless of good intentions.

    All contained in the NEWBIES FAQ sticky, post #1, including an initial appeal template.

    We deal with around 80 - 100 separate cases each day, frequently with multiple inputs, and often with complicated issues, that we cannot possibly type the same basic data for everyone who arrives here with, initially, the same problem. There are really only around half a dozen or so regular advisors here who provide significant forum input advice.

    we will need a bit more input as we are swamped with everything we have to deal with and not coping.

    the last thing we need is more stress and worry of not doing the right thing, or being in a position of having to pay them more as we believe no one wins appeals with the ipc.
