    You cannot resubmit your POPLA appeal. You submitted it, it is aone chance affair

    I presume you are now at the stage where you can view the operator evidence, and provide comments on it?
    Because you are NOT "submit defence" because a defence is at court. You are in an appeals process.

    My apologies for the late reply but I am dealing with a family health issue which has been distracting me from my appeal. The help given so far has been fantastic
    As for the request from the DVLA for didn’t get it as was away from home and didn’t have my documents with me would it be worth still applying now as I’m back home for any appeal if needed or has that boat sailed I used the keeper liability template from here as my defence
    They have until Wednesday to reply

    Whatever the outcome, imo you are likely to lose if they take you to court. Perhaps a judge might think that they are being unreasonable and award you costs accordingly, especially if you invoke Article 5 of the ECHRFF.
