Evening

My wife has received a notice of county court claim issued from BW Legal. (Hopefully I’ve managed to attach the letter in the link below)
I’ve read similar posts and looked on the newbie thread but im still not sure what stage this is all at.
The letter says if there is no reply they ‘may enter’ a ccj on or after the 3rd October.
This was dumped on my lap at the weekend so have i missed the boat date wise?

Any advice would be great 👍🏻

    Look at Palec's thread, or phoenixfreespirit, etc. All PPS/BW Legal cases.

    What's the date on the claim form?

    YOU MUST get the recipient (or you, in the recipient's name, if you are the only one able to get this ball rolling tonight) to go on MCOL tonight, now and acknowledge the service (AOS) of the claim IMMEDIATELY, NO FAFFING.

    The NEWBIES THREAD at the top of the forum, second post, tells you in pictures how to make a Govt Gateway account tonight and do the AOS, to buy enough time to defend it!

    Do that now, no more questions, it MUST be acknowledged NOW.

    That image you have shown us is only a letter telling you that a Claim Form is on the way.



    You would also be wise to change your photobucket account name to something other than your real name and delete the link from your opening post for that reason.

    No claim form from the County Court Business Centre as of yet,I will assume the letter is just a final threat before it gets serious then?

    How do I edit the post to take my details out of it?

    Nonono. Never assume.

    That letter says they HAVE filed a claim, so what date is on that letter, it would be awful if they've sent a claim to an old address, or the right address but it never arrived.

    I would email BW Legal (in your WIFE'S name - not yours, if she is the named Defendant - and ask for an urgent copy of the claim they say they have filed, as you wish to defend and they must accept this email as notice of intention to defend, but that NO claim has been served (IF they have actually filed a claim) and that they MUST NOT move to a default CCJ.

    Get that copy claim form - but you are a third party so you can't.

    All the other PPS claims on here have arrived, we have 11 others.

    the date on the letter is 13th September and then,
    'We may enter a county court judgement against you on or after 3rd October 2018 if you do not contact us or reply to the county court claim'




    i will email bw legal and ask them for what you have just stated,would it also be a good time to ask them for the evidence of the alleged offence?

    Yes why not but don't muddy the waters, make it clear that you are complying with the statement ''We may enter a county court judgement against you on or after 3rd October 2018 if you do not contact us or reply to the county court claim'' by CONTACTING THEM because you have not received any claim form. Say that if they try to enter a CCJ knowing that the claim was NOT served, they will be reported to the SRA and ICO immediately.

    Email them right now so they have the contact first thing, so they know you contacted them, and that the purported claim form was never served, and thus they have no right to enter any CCJ.

    I am worried about this, everyone else has their claims from this batch and has acknowledged them. You don't have an old address the car was registered to, do you?

    Yes the car was on personal lease when we were at our previous address and I can only assume they have our new address from the lease company as that vehicle ran its leasing period so we stayed with them and got another vehicle and new lease plan.
