You could do with a video taken in the dark - it would be great evidence to win at POPLA.

I thought you said it was ParkingEye, now you mention APCOA, another firm (much easier to beat).

  • It is Parking Eye that has issued the parking notice. What was thought to be the 'further' parking that was available is actually a separate Parking Eye Car Park, but it wasn't easily recognisable as a completely separate car park.
Also the date on their letter with the POPLA code is 30th Oct. I didn't receive it until 7th, and life has been chaos. When I've got round to dealing with it, it says I have to put appeal in to POPLA within 28 days. Can I add further evidence to POPLA after that date or does it all have to be sent at the time within the 28 day period?
  • I can sort out doing a video no problem
  • You get one shot at making the appeal.

POPLA codes in fact last 32 days so you have enough time. :)

I think we had another poster caught like this where a driver leaves one car park and enters another without realising it.

Try doing a this forum search for the same location, set to Show Posts to see if you can find it.

Found it. Same place, same circumstances by the look of it.

    Unfortunately not covered by Byelaws.

Getting photos and a video of the entrance and signage as you enter the first car park, then leave and enter the second will be critical here.

You need to shoot from positions and angles that show how confusing this is for a driver, and how they would easily miss another company's signs having reasonably assumed they are still in CRAPCOA's car park.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. It has even been suggested that some of these companies have links with organised crime.

Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

and complain in the most robust terms to your MP. With a fair wind they will be out of business in the not too distant future.

  • Thankyou all so much for the advice and references given. Will get the photos and video sorted asap.
