OK thanks for all the advice so far.
I am trying to keep this simple but want to make sure we don't miss any key facts. After discussing with my wife we are going to try and fight this all the way. She is very nervous about the whole thing as you can imagine. Neither of us can understand how anything like this can ever end up in the court, but hey ho..

Gladstones have always been and are still the same.
    Complete incompetence

If they do not comply fully to the new protocol, it's their
funeral and of late, they are hell bent on inviting the
grim reaper to join them in court whereby a judge whoops
them and orders costs in your favour

My understanding is that I will next enter the Managed Care on Line stage?
Never heard of it, what utter drivel from Gladstones who do not have a customer care ethic, ride roughshod over any consumer victims and simply rinse people on behalf of their beloved IPC members and a few other parking scumbags

''Managed Care'' sounds like a blinking care home, which is where they belong!

Your defence can be discussed later, when you get the claim.
We have responded to the Letter of claim saying we have repeatedly asked for all the information relating to the claim. So far we have had 1 grainy photo sent through, of the car backing out of the parking space.

Send the PPC (not the solicitors) a SAR, as per loads of other threads.

    info@uk-carparkmanagement.co.uk

    subject line:

FTAO the Data Protection Officer - this is a Subject Access Request (SAR)

Attach a copy of your V5 and a copy of the PCN sent, to prove who you are and that the VRN is your personal data and you are who you say you are. Also mention the PCN ref in your first sentence but make it clear this is a SAR (not an appeal).

Not a generic SAR off t'internet.

One that asks specifically for all data held and processed, including what you want to see, which is:

    - all photos taken on the day;
    - all human intervention notes, starting with the ''wardens'' (homeless man's) case notes and all case status updates,
    - all electronic data including automated decisions to generate letters, etc
    - a close up of the sign on the day with the car parked/empty in the same view (they can't do that but that's what you ask for!)
    - all photos taken relating to this case, withholding none at all,
    - and copies of the PCN and all letters sent.

End it by saying this is a SAR but also an Objection to Processing and a formal request to Restrict Data Processing, because their evidence will disclose no parking event. As such, any litigation MUST be on hold and you will be making an Information Commissioner's Office complaint next, about UKCPM's breach of the GDPR, mishandling of the SAR and Restriction of Data request (because we all know they will chuck it back at you) and misuse of your personal data evolving from: intrusive, unjustified, predatory and disproportionate collecting of photographic data of a car with a driver in it, turning round, not parking at all and certainly nothing that can be described as 'reasonable cause' to get DVLA data and then demand money.

And email a copy to the care home (Gladstones!). Still laughing about that!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD
  • I like reference to "homeless guy" , an avid description of a UKCPM employee

    I see to faults here

    1: predatory tactics ,

2: you were not parked , nor did you get anywhere close to the grace periods prescribed in law

I note you mention "taxi bay" and railway station , it should be noted what is written on the PADI webpage

"The company offers ticketing "packages" so that anyone wanting to earn some commission [think they] can ticket anyone anywhere. Check with the location that UKCPM were actually hired to work there. If not report to police."

I would be checking with local council regarding ownership of taxi bay , and checking with train Co regarding ownership and boundaries

remember signage on lamp posts etc , can be easily fitted , but do they have authority to issue tickets there , and for what? , parking , entering "private" land , turning round

there contract , if it exists may say differently

YES ..... but surely for the Gladstones/IPC boys,
prison is the only place for them

Hello again lovely people, the vultures are back from Gladstones and I'm looking for more advice.

I sent my letter before claim response back in Oct 2018 as suggested and didn't hear anything back until last week. Just before I head off for a nice bank holiday weekend, I get a lovely letter from Gladstones starting the whole issue up again. It really drives me mad that the letter says we apologise for the delay in responding (7 months!!) but then gives me 30 days to respond..

The letter attempts to answer all the points I raised in my Letter before claim which I pulled off the newbies thread. The general response being they say I'm in breach of contract and they are going to take me to court.

The letter also includes a mass of paperwork I can fill in if I want to declare my entire earnings, credit history and life story to them to prove I'm in debt?! Or a reply form which allows me to admit liability in some way.

Basically, I know my wife wasn't in breach of contract as she never left the car and only pulled in to avoid driving down a taxi only lane. They have no proof she was parked for any period, as they only have one picture which shows her in the car. Plus there are a number of conflicting signs which would at the least need her to get out of the car to understand and read.

It looks like this is just another letter where they are trying their luck, but I’m not clear on what I should do. Any advice please?

You've already responded to their Letter of Claim once.

Sit back and wait patiently for a County Court claim form to drop through your letter-box.

Whilst waiting, you might want to re-read post #2 of the NEWBIES thread to fully understand how to deal with it.

The LBC giving 30 days to reply.

Ignore ALL forms to complete, you simply cannot give scammers your private info which they are not entitled to

Have they given you proof of their claim, pictures etc etc and proof of the charges/costs.
    Have they added a fake $60 ???

Now, you rebut their claim with your proof.

Do bear in mind that Gladstones are highly incompetent solicitors who probably are unaware of what they are claiming for.

Do not phone them as recently one poster here did just that and got a very rude woman who thought she was Attila the Hun

Yes, they have provided me with everything they have. Which is basically a picture of my wife sitting in a car and a close up of one of the 5 signs she never had chance to read.

Surely you meant to say"...a picture of an unknown lady sitting in a car".

Whilst you may know who that lady is, neither UKCPM nor Gladstones have any idea about who the driver might be.

Who is the Registered Keeper of the car?
