Hi all,

Long story short I have been fighting off a UK CPM PCN issued in July 2016 - all scary red letters from scammer X and Solicitor Y received. I had prepared my case and was waiting for the court papers to drop through the letter box....it turns out they did, at an address I've not lived at for 3 years!

Flash forward to today and I've got a cracking black mark on my credit report and have gone through the motions of tracing the CCJ and contacting the issuing court.

I have settled in full as the court hearing date was 19/09/2018 and I obviously missed this.

The CCJ was a few pounds shy of the £255.00 amount for challenging the CCJ in court so on this occasion I have taken the hit.

Is there any point now trying to challenging the issuing solicitor for costs or shall I let this go and move on with my life (applied for a certificate of satisfaction today in order to ensure my credit file is as it should be)

Offending solicitors are Gladstones (shocking I know) issuer of the PCN was UK Car Park Management.

  • I thought as much, a little under handed sending docs to my old address but will put down to experience.

    Credit file wise will the CCJ simply be removed once the cert of satisfaction is granted. Due date was 19.10.18, paid in full today.

    So, you have paid the scammer, (the organ grinder) and now you want to punish the monkey. I am not an expert on CCJs but it seems that, having paid the Dane, you have made your bed.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P.
    for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
    You never know how far you can go until you go too far.

    The ccj should be removed from the register as soon as the claimant notifies the court

    So you are in their hands

    If you want to do this yourself and have proof of payment (with cleared funds) you can notify the Court (fee to pay)

    You say there was a hearing on 19/09.

    Are you sure on this.

    Normally no hearing if the defendant fails to respond.

    The claimant gets a default ccj without any hearing

    I think he means a default CCJ order, and thought that meant there was a hearing.

    I am shuddering at the sight of your avatar again - seen you before on here! - but have to ask, did the Claimant know what your correct address actually was, had you replied from it?

  • Hi guys. Having contacted the court this morning I was informed the hearing had come and gone, the customer service agent advised two options:

    1) Pay the CCJ amount in full
    2) Apply to have the judgement set aside at a cost of £255.00

    I have either been misinformed or have over reacted this morning, however what's done is done and I would just like to move forward now.

    The claimant did indeed have my new address (and my telephone number!?) Would I be right in saying the court would issue documents to the address provided by the claimant? If I had the funds i would most definitely be pursuing this further.

    They sare supposed ot use the last known good adderss. If you had told them explicitly that your current address was your address for service, they are DEFINITELY in the wrong, if you did not then they have some claim to make, but ut is still week to say that despite knowoing you are corresponding from X address they will issue against Y because it was where the car was kept initially, a court should find that ludicorus.

    You can still apply for a set aside, if you wish, and have a VERY good grounds to do so - they could not have effected good service, as they knowingly used an old address, and worse for them confirmed under penalty of perjury that they are using a last known address.
  • @nosferatu1001 - thank you, food for thought. Totally agree as to the underhand approach, and to the practice of these companies in general and by all accounts it looks as if the practice of PCN's will dramatically change come December this year.

    This post wasn't intended to be a 'woe is me' type rant, I was just interested in the community feedback. Regardless of the amount this has been unpleasant and stressful, assuming my credit file doesn't take a massive hit (I know, ignore the score) I will be putting this one down to experience.
