BW Legal County Court Claim for ignoring PCN

  • Hello, I have a question please, when asking for evidence from the claimant, who should I be writing to, BW Legal or Parking Awareness Services? I would’ve thought it would be the legal firm, but not sure. Is there an allowance on how quickly they need to respond to me? Something tells me they will not send me details of their claim and will make me waste my time waiting while defence time is running out.

    Ask PAS as BW don't have any.

    Problem is that PAS can take 30 days and you have to file a defence before then.

  • Thank you, that’s what I thought, but I might just write a letter and carry on researching my defence and mention in my defence that I have asked them for evidence in order to prepare my defence as such a long time passed since alleged offence.

    You dont need evidence for the Defence - just make your best assumption and make the arguments that correspond. All you can do.
  • I wasn’t sure about disclosing the date of Claim in here as I can be identified then. I thought dates and names should stay emitted. From what I’ve read, claim is officially filed on the fifth day from the date on the letter and I’ve already filed AOS on the fourth day after receiving the claim. I’ve received the claim two days after the date on the form, so I should have at least 25 days left. Is it ok to specify dates?

    You can safely disclose info like the claim date on here, and show your draft defence. If you didn't know that, I say you haven't read enough defence threads yet as people ALWAYS get asked for the date of claim and what the POC says.

    Just don't say stuff about who was driving, if you are intending to defend as registered keeper without them knowing who the driver was (if they don't).

    It's been answered but you do know that isn't just a bog standard letter, it's a SAR* to PAS, addressed to their Data Protection Officer (check their website for the contact details, if they have a Privacy page - maybe they have a dpo email).


    *search the forum for SAR is that's not familiar, if not already on this long thread.

  • Unfortunately I didn’t had a chance to read all the Newbies feed yet and defences, I wrote before that I’m planning to to that this weekend, swamped at work and home.
    The day on the letter is 27.09.
