    They agreed they were faulty. Their point was that they were only giving a full refund if he was measuring the same size.

    Surely that's like saying your trousers are faulty but because you are now too fat for them we can't give you a full refund. Or those shorts are faulty but because the summer is over we can't give you a full refund. They were trying to use circumstance to get out of refunding. But the shoe was being sent back to Clark's, for the retailer to no doubt get a full refund.

    Yes - its exactly that. If i buy a pair of trousers that fit me perfectly, however i put on two stone in weight and they split the seam, then i can hardly blame the manufacturer can i?

    Same with childrens shoes. Its a possibility that the child's foot had grown and thus put stress on the straps.

    I would suggest they would have to be quite stringent with their returns policy given this, as otherwise they could end up with a load of shoes that Clarks wont take back....

    You'd be surprised what customers try to pull by the way - and i've had thought the "my child's shoes are faulty" card would be quite a common one. I was behind a "lady" in M&S recently, returning a shirt that her husband had worn - totally split about 8 inches at the elbow. She vehemently argued that it was a faulty shirt and wanted a full refund despite no receipt. The manager came out and found (a) the shirt was an slim fit and her husband was by the womans admittance "of a heavy build", and (b) they hadnt sold that shirt for 18 months. Clearly he'd had it a couple of years, put it on, split the slim fit sleeve and then she was there "demanding" a refund. It was laughable to watch, particularly as you could see the woman trying to back out when she was rumbled. I can only imagine what a childrens shoe shop section faces daily...

    Oh, and they wouldnt get a full refund, they'd get a credit for the amount they paid for them - so if they bought them at £30 and sold them at £60, then refunding them puts them out by £60, but they will get £30 back from Clarks, so they're still £30 down.

    They also denied a 3 year old who was bursting to go to the toilet to use their staff toilet. But they had his shoes away with them so we couldnt leave the shop.

    How were you planning on leaving the shop after you got your full refund?

    What they are saying here is false but you might need to capture evidence of this. You should certainly email Clarks customer service and lodge your complaint and appeal for a refund/replacement

    I don't know why you bother ... your advice is generally so far off the mark that it could be dangerous to follow it.

    What they are saying here is false but you might need to capture evidence of this. You should certainly email Clarks customer service and lodge your complaint and appeal for a refund/replacement

    They didn't buy them from Clarks

    Am I missing something here?

    Could the store simply have handed OP a pair of shoes of the same make and size as a replacement?

    If so, I feel that any complaint OP makes is akin to punching someone below the belt..

    Probably not as little Johnnys feet had grown so he would have needed the next size up rather than a straight exchange :rotfl:

    As the retailer I'd certainly have considered the repair/replace option rather than the refund :rotfl:
