CIFAS / National Hunter

Hi all,

I need a bit of advice. I recently done a Subject Access Request with National Hunter and CIFAS.

Sadly I have an entry on CIFAS that is legitimate due to my misgivings whilst I was younger.

On the form the application date is 11th September 2008 and
Date Recorded: 11th Sept 2015.

This was my entirely my fault as when I was going through a bad period of mental health etc in my life I took £6,000 from a family members savings account. I went to court for it and got sentenced etc but TSB did not ask for any compensation. It is categorised as First party fraud which I think is the most serious..

Since this I am declined from EVERY bank I have tried - including credit cards. basic accounts - and in the next 1-2 years I want a mortgage. So my dilemma is confess and admit that I want to pay the money back, which would be a good moral thing but I can't afford it if they are going to not remove the CIFAS

I have a few questions:

1) I assume this is why I am being declined, thoughts?
2) Will it expire from September 2015. Should it be gone by 2021.

I didn't pay any of the money back from the start as they did not ask. I am thinking about ringing them and setting them up a savings plan so I can get the CIFAS marker remove. Part of the reason I have not contacted them as was reluctant to pay up, but if I sent them a payment plan, do you think they would take the marker off or that they drag it on until I do get paid enough (which is probably time that I was declined for me,

What do you think? And is credit-score, CIFAS and National Hunter the main places will notice this and refuse it because of this. I earn decent money now and still have no line p credir

  • They aren't going to remove it on the basis of you paying them back. It is an accurate reflection of what took place, which they are obligated as part of their CIFAS membership to record to the best of their knowledge. If people were able to buy their way off the register, it would be meaningless.

If you want to pay it back (as you note, this would be the morally right thing to do) then do so, but I think if you approach them with an "I'll pay it back but only if you remove all record of my crime" then not only will you have got their attention, but they are likely to look upon your case very negatively indeed.

I would be inclined to let sleeping dogs lie and run down the clock until the warning drops off.
  • They can keep them on for longer than 6 years as well

With the marker not going until 2021 t the earliest and the fact you can't even get basic credit, not sure how you're going to build a good credit history to get a mortgage? Best thing to do is I guess try the lowest of the low sub prime market cards and try and get something you can use and pay off in full each month, maybe a sim only mobile deal, that sort of thing. Else just build up a big deposit and see a specialist broker in a few years

Sam Vimes' Boots Theory of Socioeconomic Unfairness:

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

Thanks for the responses -- when you say they can keep it for longer than 6 six years, is that under certain circumstances or not really?

My point is not the crime, as that is something that I have dealt with a legal and moral way. #will it be on CIFAS for 6 months or could it be longer
  • If you earn decent money as you say, then you should pay it regardless of whether the marker will be removed or not.
