No debt has ever been proved. This is a byelaws case and therefore only a magistrate's court can decide that a debt exists as a result of a penalty conviction (or whatever the correct terminology is).
The claim is now statute barred by the Magistrate's Act and therefore there can be no conviction and therefore no debt can be proven, or now occur. The basis of complaint is they no longer have need to process your data. The law is clear this times out after 6 months. You shouldn't have to prove anything.0 -
I recently picked up your message. I have only just accessed the new forum. If the incident that you mention in your message relates to the railway car park at Burton on Trent my parking ticket was not in relation to this car park but the Excel Derby Street Car park. Myself and other posters have defended claims with regard to parking tickets from the Derby Street Car Park. The Indigo Car park and the Derby Street Car park do overlap and it can be confusing.
