Norwich Traffic Control make claim via Northampton County Court against me... HELP!

    How does this sound as a request for copies of all letters under GDPR?

    Dear Sir or Madam,

    I am in receipt of Claim No. XXXXXX, issued on 25th September 2018. This is the first of any documentation I have received in relation to this claim.

    I am writing to you in your capacity as data protection officer for Norwich Traffic Control so that you may provide me with copies of all documents (paperwork, pictures, evidence) that you allege to have sent in relation to this case. Due to the woefully inadequate particulars of the claim presented, it is imperative that NTC present copies of all documents they intend to use in the case. I am sure NTC will already have these documents to hand in order to issue the claim in the first instance, and therefore I demand that NTC provide all documents within 7 days.

    Please be aware that am making this request for access to personal data pursuant to Article 15 of the General Data Protection Regulation. I would like you to be aware at the outset that I expect a reply to my request as required under Article 12, failing which I will be forwarding my inquiry with a letter of complaint to the Information Commissioner’s Office.

    clock's ticking.... out of interest what happens if they ignore my request?

    assuming that you gave them 30 days notice or whaever, you would report them to the ICO if they fail to reply or fail the GDPR requirements


    meaning its down to you to report them to the ICO for failing their obligations under the law

    Hi All,

    Just an update. I sent a SAR to both BW Legal and NTC on 27th September 2018, for which I obtained a certificate for proof of postage. I also emailed NTC.

    BW Legal responded by sending copies of their own generic documents that they allege to have already sent. There was zero evidence attached or any elaboration on the particulars of claim. For what it's worth, the only copy of those documents that I have already received is the 'Notice of County Court Claim Issued' (which was received after the actual claim form from Northampton).

    NTC have been somewhat more awkward in fulfilling the SAR. They have not responded to me in writing, but there has been email correspondence that simply appears to be them wasting time and doing their best to delay the fulfilment of my request. The email chain is detailed below:

    "Dear Sir or Madam,

    I made it very clear in my first email that I would like all information you hold attached to my name, and for any VRN attached to my name, not just for the claim in question. As I mentioned in my first email, the claim put in on behalf of yourselves by BW Legal (for which I am sure you are aware of the claim number - XXXXXXXX) is the first of any documentation I have received. Therefore, it is impossible that I could be aware of 'your reference number'.

    The court documents were sent to myself, XXXXXX, at XXXXXXX, Norwich, NRX XXX, for VRN XXX XXX. To reiterate, I am writing to you in your capacity as data protection officer for Norwich Traffic Control so that you provide me with copies of all documents (paperwork, pictures, evidence) that you allege to have sent in relation to this case. Further, I require screenshots/copies of all photos (whether sent in a letter or not) and all internal notes, emails, status updates, DVLA look ups and all online data held/stored or shared by you, about me or my VRN.

    Failure to provide the above mentioned data that you hold on me and any VRN associated to me is in clear breach of GDPR, for which I remind you that I will be forwarding my inquiry with a letter of complaint to the Information Commissioner’s Office. It may be in your interests make yourselves aware of the penalties and consequences of failing to adhere to GDPR legislation.

    Please be aware that by emailing, writing to or otherwise contacting Norwich Traffic Control Limited. it's partners or subsidiaries, I do not give consent for the retaining and processing of my data, nor for it to be passed onto third parties.

    Your legal representatives, BW Legal, have responded to a subject access request in relation to this case. As a result of the subject access request I have an account reference number of XXXXXX.

    I am not willing to provide NTC with a copy of my driving licence for proof of identification. This document contains sensitive information and I do not trust that this information will be handled in good faith. You have already identified me, (Elgordo9), at (my address), by passing my address and name onto BW Legal in order to begin the proceedings of issuing a county court claim. The person making the request (XXXXX XXXXX - myself) is therefore quite clearly already obvious to you. I am asking you to send information that you would allege to have already sent to XX XXX XXXX (i.e. copies of all documents in relation to this claim). You do not require proof of identification to fulfil this request.

    Please be aware that to this date, despite several requests, both NTC and BW Legal have failed to provide any evidence to support the extremely vague and inadequate particulars of claim for this case.     I intend on building and finalising my defence over the next couple of days, but due to the lack of evidence that has been presented to me in relation to this claim, I guess I should look to adapt some of the already existing defences that are present on this forum?
