Hi all,
I would like to ask the kind members of this forum for assistance with this case. We have received a debt collectors letter from Zenith Collections on 14/09/18 and after finding this forum have only then looked through our letters to find the original PCN NTK which we had mistakedly put to the side.
The date of contravention is on 09/06/18 and the PCN NTK arrived on 19/06/18 so it is within 14 days. What happened on the day is we paid a pound and overstayed by about 20mins which is our fault however does not justify the cost of £60 and now £100.
The PCN NTK is with the POFA 2012 paragraph with the words 29 days.. unluckily not the golden ticket. I have read through the newbie thread and sent the First Appeal template as per advice to the email on their site as per the back of the PCN NTK on 21/09/18, after the input of the Parking Charge Number and Vehicle Reg. did not retrieve a ticket on the website.
We hoped that they would then send a letter through the post as requested to enable us a POPLA appeal, however they came back by email to say that it is out of their hands and with the debt collector - From the advice on this forum, as far as I understand it is best to ignore debt collector letters and it is never too late to appeal even though it is months from date of contravention. The email from the PPC on 24/09/18 is below:
Good Morning X,
The terms and conditions of the car park detail that your information may be requested and shared with the BPA, DVLA , debt recovery agents and solicitors.
The Final reminder that was sent to you also advises, “If this notice is ignored, further action may be taken including instruction of debt collection agencies, solicitors and or court proceedings, all of which will incur further costs. To avoid further unnecessary costs or actions please pay the Parking Charge within the aforementioned time period.”
Britannia Parking laid clear the terms and details of our appeals process and payment to resolve this Parking Charge Notice, and cannot be held responsible for postal correspondence remaining unread.
As this PCN has been passed to Debt Recovery, a separate company from our own, Britannia Parking have no further comments to add regarding this PCN and consider this matter to be out of our hands.
Please refer all future correspondence to Debt Recovery.

Where did ParkingEye come from? They wouldn't be messing about with bit-part actors like DRP and Zenith.
I'm sure they'd be absolutely disgusted to be legal linked in the same sentence (or even paragraph) with them - give PE some very basic respect, please! :cool:Please note, we are not a legal advice forum. I vaguely remember two ticket machines - it wasn't me who went to pay, but I have checked google maps and yes there are two and we used the one on the right as opposed to the one closest to the entrance.
I find it strange as all the other Canvey island threads have been Parkingeye - just as well if Britannia aren't as litigious0 -
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently
