Personally I think it's risky introducing anything else at this stage that would be shared/discussed/negotiated with TSB, as the adjudicator suggests it would, because this could actually push them further away and lend credence to their apparent contention that Cotta is out for all he can get his hands on.

Her mention of her manager does seed another thought though: if this isn't sorted out by next week's deadline, you could perhaps insist that the matter is dealt with either by the manager or the ombudsman from then on, rather than an adjudicator who is too cosy with her colleagues in TSB....
That's a fair point, any further back and forth is just going to push the final resolution farther into the future.

I do like the suggestion of putting a deadline on the Adjudicator to sort it out or pass it on.

I like the idea of the FOS just getting rid of that adjudicator, but that's just wishful thinking.

    Agreed

However in order to do this you need to be explicit in your response.

    "Dear FOC adjudicator

Thankyou for your update. I will, as advised wait one further week which will conclude a total of x number of weeks wait. Should this matter not be resolved by Thursday 17th January 2019 I request all further contact to be escalated to the ombudsman. Failing that i wish to be contacted by your line manager directly with a full explanationas to why this has not been actioned.

I aslo request that all contact with the FOC after your response on18th january 2019 come from a manager as I feel that you are no longer impartial in your views.

    Yours

    cotta"

    .....or something like that

This woman telling you to "be patient" or "exercise patience" is really getting on my t1ts now.

Fortunately we only see one side of the negotiations. So we only see "my colleagues" and "be patient", and not "that complaining scum" and "take all the time you need" ;)

This has crossed my mind in that I may be thought of as greedy now, back to Eskbanker's point, if this goes to the Ombudsman they may look dimly on me as a compensation hunter.

On each occasion it was the Adjudicator that introduced the topic of additional compensation and directly asked you to come up with a figure. The Adjudicator's manager suggested figures being bounced around were too low. So it would be a very unfair judgement for an Ombudsman to consider your responses to be those of a "compensation hunter".

    A small update as such:

    Dear Mr. Cotta,

I wanted to let you know that I was in touch with my colleague from TSB on another case today and I took the opportunity to ask about your compensation. My colleague advised that your compensation has not been approved by TSB from a senior level as of yet, I also got a strong indication that they are waiting for the clock to run down.

When next week comes your going to face some big decisions if the clock has ran down with no action taking place.

    1) You can opt to refer this to an Ombudsman, however the amount awarded could be significantly less than my recommendation. Historically we usually find the Ombudsman rubber stamps our suggestions, however your case maybe very different.

    2) Drop the case completely.

    3) You can opt to negotiate with TSB and I will help facilitate this. This is not my recommended option because whilst our partners at TSB are good to work with they appear to have taken an exception to your case as they deem you as someone who was never a customer of theirs yet has received significant compensation.

Something for you to think about over the weekend.

    Regards
    FOS

The message seems much the same as before, no less irritating, that's for sure! Not sure if you're minded to respond but I still feel that she should be telling them that if they don't formally reject the FOS instruction (not suggestions, recommendations, etc) by a specified date then they'll be deemed to have accepted it, rather than her apparent expectation that they can just let it drift for as long as they choose.

Coincidentally I walked past the TSB registered office a couple of hours ago, tempting to stick my head in the door and ask how many FOS adjudicators were working in there ;)

Personally, I'd be asking for a call from her manager at the earliest convenience to discuss this latest communication. I'm beginning to question whether this is an elaborate hoax as I simply cannot believe what I'm reading.

It's infuriating to say the least, I have no confidence at all in FOS.
