Parking Charge Notice NI

Options
CPS parking have issued me with a small claim to bring me to court. They have stated my vehicle was used on 4 ocassions on one of their car parks in Belfast. Accumulating the sum of £450 plus court fee £59.
It states it is a member of BPA with approved operator status. Are these valid and will they be successful in obtaining a judgement against me or do I have a case to argue their validity? Any help would be appreciated, I’ve to respond by Monday but only seeing forms as work in Dublin.

Has this claim come from the Court?

If so you must respond within the deadline - otherwise the claimant will be able to win by default! (Have you not received other correspondence leading up to this?)

You can get advice on court claims in the newbies faq thread near the top of the forum (#2 there).

I can't find any PPC with that specific name on the BPA list of operators. We need much more information from you please.

Have you had any prior communication with them? Unfortunately the lack of information makes giving meaningful advice nigh on impossible.
  • Which court did the claim come from? Does NI have its own court system, separate from England & Wales (like Scotland)?

In any case, there is no POFA in NI, so they can only pursue the driver. If you've never told them who the driver was (and don't say or even suggest who was on this forum), they are going to struggle.

I just wonder whether the OP has read this. Not saying it's an extension of the scam, but worth considering.

  • Sorry for late reply, yes I had previous correspondence but like most I ignored them thinking it would go no where. This is pic of small claim application.
  • Sorry I tried to upload pic but don’t know how too, it says Car Parking Services Ltd is member of BPA membership BPA 2942 with approves operator status. I think I should dispute the claim, any help would be greatly appreciated. It’s the Northern Ireland courts and it’s definitely legimate paper work.thanks for help in advance

Have you any more information about them? What about their physical address? Phone number? Website?

    Check them against this list:

    https://www.britishparking.co.uk/BPA-Approved-Operators

Can you find them there? If not, email Steve Clark of the BPA to check out their bona fides.
