Hit an animal - act of God - good or bad?

Hi

A friend has hit an horse in his car. The car is written off and he has some injuries. His insurance company say they treat this as an act of God.

What does that mean in practice and what else could he do?

    Act of God just mean "anything not listed isn't covered" doesn't it?

    dont want to sound stupid or harsh but how did he hit a horse?
  • Does your friend have fully comp. insurance? if so, he should be able to claim no matter what...did the horse escape from its field? If so, I would be inclined to pursue the owner. As far as I knew, the only domestic animal you cannot be liable for hitting is a cat, so I guess he must be careful that the owner doesn't come after him. Unless it is a semi-wild horse? Although even if it is a Dartmoor pony, they are still owned by people.
    Also, what if your friend doesn't believe in God?

    The horse did not have a rider and was on the road.

    Hitting animals is not unusual in the countryside. I read of a chap who hit a cow on the A303 in Somerset the other week (clicky). Sadly, he died.

    Deer can be a bloody nightmare, particulary early evenings or mornings. I used to have to drive across Ashdown Forrest to get to work and had several narrow escapes!

    That would have been his fault.

    My view is that the owner of the horse should be liable. I guess the insurers (of the car) won't be very helpful.
