Where do i stand car bought from garage.

Hi, i bought a mini from a garage. Was told their was a fault with clutch and the gears had problem changing. So i bought the car knowing and being assured these were the only faults. Drove it straight to a garahe and got a new clutch put in which then needed a new gearbox, it also needed new wheel bearings new brake pads and the radiator has a hole in it along with cosmetic issues. On the receipt from where i bought it from it says car sold with sll known faults gearbox etc car ti be fixed before road use. I am currently sat in a car park now broken down with what i think is a flat battery can i take this car back to original garage and request money back?

    Bought a dog and is now realising how bad it is :(


    You are probably best standing at the bus stop if you don`t replace the battery(or find out why has drained)
  • Clutches and gearboxes aren't cheap fixes in most cases. Factoring in the costs against the value of the car, you are now potentially better off keeping it. They won't take the car back and they won't pay you the costs with faults they told you about.

    The undeclared faults. You could try asking them to reimburse you for. But they don't sound like a good garage to be honest. Have you considered contacting Trading Standards for advice?

  • Thanks for the replies, wouldnt take back just for measly battery. Am just concerned as there are more faults than explained, it just seems never ending when initially all i was told was it would just need a new clutch.

    This comment on the receipt acknowledges you are buying the car with faults that makes it unroadworthy - it says that all the known faults need to be fixed to make it roadworthy. It doesn't say whether any unknown faults need to be fixed to make it roadworthy, in part this is because neither the garage nor you knew about any unknown faults, but also without knowing what these faults are no one can say whether they render the car roadworthy or not.

    If you had got your assurance the declared faults were the only faults, then you would have a claim, but you don't seem to have it writing. If you have replaced the wheel bearings, brakes and radiator and fixed the cosmetic issues it would be daft to return it to the garage as the are getting much better car back but they only owe you what your paid for the car.

    If the battery has gone flat, the alternator might have failed .If this is the case, then it is worth asking the garage to diagnose and fix the problem. Even if they fit a cheap replacement part it will get you mobile again for many months.

    You just need to buy a new battery, check the alternator is charging ok and buy some breakdown cover - what else can go wrong, engine maybe. If you had done research you would of seen that Mini gearboxes are not good so a car with "clutch" fault should be sent alarm bells ringing and instant £1500 off the retail price to allow for a secondhand gearbox.

    No point in rejecting the car now you have bought a clutch, gearbox, radiator, brake pads - didnt give the supplying dealer a chance to fix it - the cosmetics you would of seen when you bought it. I just hope it was cheap enough for you to buy in the first place.

    Although the law says that you cannot sell an unroadworthy car these days - not sure what you would get out of it going to Trading Standards but by all means use a bit of your time and go down that road. Doubt you will get a cheque from the dealer though for what you have spent on it.

    You can't do that, they don't deal with complaints direct from the public, you need to go to Citizens Advice.
