Hello Forumites! In order to help keep the Forum a useful, safe and friendly place for our users, discussions around non-MoneySaving matters are not permitted per the Forum rules. While we understand that mentioning house prices may sometimes be relevant to a user's specific MoneySaving situation, we ask that you please avoid veering into broad, general debates about the market, the economy and politics, as these can unfortunately lead to abusive or hateful behaviour. Threads that are found to have derailed into wider discussions may be removed. Users who repeatedly disregard this may have their Forum account banned. Is there a Form A restriction on the registered title, namely

'No disposition by a sole proprietor of the registered estate (except a trust corporation) under which capital money arises is to be registered unless authorised by an order of the court'

If so that will stop the surviving sole owner selling on their own, they would need to appoint someone else to do it with them.

Has probate been granted and if so who to? Does it include you brother?

Your brother, as executor, should get in touch with the selling solicitor to find out what is going on.

Do you even know for sure the property was held as tenants in common rather then joint tenants?

Today I found out that the deed was drawn up in 2001. For reasons unknown it was not registered. My fathers partner is supposedly completing the sale in 3-4 weeks. According to my brother she has been forthcoming and cooperative. Obviously I would be happier if my fathers name were on the deeds. She is acknowledging our fathers share so far. So what choice do we have but to trust her to have integrity and do the right thing in our fathers honour?
