UKPC Parking "fine" appeal

Okay, so a few weeks ago i received a parking "fine" (charge) from UKPC for parking for longer than the three hours allowed in Edinburgh Park retail carpark.
I had a look on here and followed some advice saying not to pay.

I decided to appeal the charge as I felt I had a valid reason for being late back to the car.
We parked there, used one of the shops quickly and jumped onto the tram into town to meet a friend. We had every intention of coming back in time for the car.
My friend suffers from quite severe anxiety and had a panic attack while we were there. To make sure they were okay we waited with them until a member of their family arrived.

Because of this, we were significantly late back to the car. I can't remember how late we were but it was around an hour.

In my appeal I explained this and said that I didn't feel I should have to pay as the circumstances were out of my control.

Today I got another letter from them rejecting my appeal. Booo!

I'm just wondering the best course of action from here if anyone could help?

I'm not going to pay the charge unless I absolutely have to but after reading some forums on here it sounds like the general consensus is that the charges are unenforceable and basically a scam.

I'm just wondering if anything is different for me because I already started the appeal process?

Any help would be greatly appreciated :money:

    Wait, you got a PCN from UKPC at a Scottish site, came here and didn't read the specific Scottish advice in the NEWBIES thread, then decided, against all advice on the forum, to tell them who the driver was?

    The one piece of evidence they needed in Scotland and you gave it to them?

    You need to complain to the retail park to get this cancelled as you just handed UKPC the person they can sue in the Sheriffs Court, that they would never have known otherwise.

    Luckily, the Managing Agents will be able to cancel it if you tell them that they are liable for the conduct of UKPC in discrimination against a person with a disability under the Equality Act 2010.

    Or you could try a friendly Store Manager to cancel it, especially if you shopped there.

    You are in Scotland and the clear advice here (even if you were not forum savvy, but just searched this parking forum for the word 'Scotland') is NEVER NEVER tell a private firm who was driving...

    I did a few searches and wasn't aware of the NEWBIES section or that the rules were different in Scotland. I read a few threads and didn't see anything about that unfortunately.

    When you say "Managing Agents", do you mean the BPA or UKPC themselves?

    I'd be very surprised if my friend would be willing to supply evidence of his anxiety as he's quite... well, anxious about it. Do you think that's something they'd require?

    I was wondering if it was hermiston gait or the gyle.

    Heres a link to it.

    My initial thoughts on hearing edinburgh park retail park was that if its hermiston gait, their signage is pants. None displayed at the entrance and inside the car park its only every 2nd row at the ends (never in the middle) and in a font size that you'd be unable to read from any sort of distance.

  • Yeah it was definitely Hermiston Gait but I saw at least 2 signs between my car and going into the shop and then to the tram so I don't know if I could fight it based on that. I tried being honest with them but got nothing in return so I've followed Coupon-mad's advice and gone straight to the managing agent. The only details I could find were there physical address and a contact form though so I used the form. I'll wait a few days and if they haven't got back to me I'll write a letter :)
    Hopefully that'll settle it!
