I can only assume you missed this in post #3 of the NEWBIES FAQ sticky thread:
These then get saved as PDFs and uploaded to POPLA under OTHER (ONLY) - do not think you only have 2000 characters in some box on the POPLA wepage!

I did indeed, I was searching under the "Parking Tickets, Fines & Parking" forum for "POPLA 2000" as my keywords, naturally only showing recently updated posts. My bad.
  • Its been a week and its still in progress at "Operator Information and Evidence". I guess if it's taking this long, they are looking at all my appeal points and countering it no doubt?

Do they take this long normally?

    They have 21 days.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Afternoon all,

So the operator has finally come back with 6 docs, of which 5 are my appeal along with their PCN reminders. The 6th letter is as written as follow....

Exceeded the maximum stay time patrol officer
The Terms and Conditions of parking at this location are clearly displayed at the entrance and throughout the site. The onus is with the driver to ensure that when parking on private property they do so in accordance with the Terms and Conditions. Your vehicle was logged by patrol officer as the vehicle exceeded the maximum stay time which breaches the Terms and Conditions of this site.

And that's it. What's the best way to comment back with regards to this? Do I as a keeper have a leg to stand on? Or would it have to go to court?

This was my POPLA appeal https://drive.google.com/file/d/1g6aj5PrCruM_INGpSCIt6QjvQU6SAXGu/view

    Many thanks.

So no signs, no Landowner contract, no copy of the NTK?

I'd work on the basis that as the PPC has not disputed any of your points of appeal then POPLA must take that the PPC agrees with the points you make. List each heading of your appeal points, then under each one put words to the effect 'TPS do not dispute this point, the assumption must be made that they accept it, and POPLA must find in favour of the appellant'.

You have, effectively, 6 days to respond to POPLA. Note you have only 2,000 characters (not words) to play with and you must use the website portal.

If you've got a couple of days (or more) before deadline, see if other regulars agree my tack, or whether they have an alternative.

That was part of the initial PCN issued to me as the keeper, 3 of the docs were the reminders/PCN initially sent. The other 2 were my appeal to the operator initially, and the operator refused appeal reply.

Thank you. I have 7 days from today. I'm surprised all that they've written is that one paragraph in a word doc. I couldn't log on to the appeal site so this is the 6 attachments that POPLA have forward on to me.

So is that yes or no?

Have they included photos of the signs and a copy of the Landowner contract ?
