    Hi All,

    I've been in a DMP since August 2016 with Stepchange and everything is going smoothly, albeit slowly.  All of my loans and credit cards have defaulted and I'm coming up to six years for nearly all of these, some hit that milestone in December last year and January this year. 

    Most of the debts have been sold onto PRA or Westcott but I'm wondering how do I see whether these have dropped off my credit file.  Yes, there are still balances and I'm not looking for more debt but my credit karma score is sitting at 513 and hasn't changed.  I've looked at the closed accounts and none are there.

    Any advice or guidance would be great

    Err, by checking your credit file I don`t know any other way.

    If they have gone over the 6 year mark, they won`t show any longer anyway.

    Hi All,

    Thanks sourcrates, I know there are outstanding balances but wouldnt these show on the closed accounts or do they just disappear from the full file

     - my anxieties and worries are if I start to do these things will it trigger the likes of PRA and Intrum to start taking action with me and I might end up with a CCJ?  Currently it seems the arrangement in place is keeping everyone happy and I am sooooo close to the defaults dropping off my credit file.  Should I just leave well alone? 
    Any advice would be greatly appreciated. x

    Settlement offers are usually triggered when an account has been on the DCA`s books for some time, or when you make such an offer to the creditor, lots of accounts are dealt with in this way, perfectly normal.

    Making a request for information under sec 77/79 CCA, is one of the statutory rights gifted to you by the consumer credit act, lots of people do this, you cannot be adversely affected by exercising your rights.

    Also there is no "keeping them happy" that`s all in your mind, in reality, a business makes commercial decisions, based on how you run your account, it is never personal, legal action is usually reserved for those who ignore their debts completely, not for those who are paying them.

    Doing either of the above will not impact how you are treated in any way, shape or form, please stop overthinking things, that would be my advice.

  • Hello, I’m looking for help figuring out a plan. I defaulted on 3 credit cards in 2019 during a difficult time and I’ve ignored all correspondence/calls since whilst I pieced my life back together. The threat of a home visit has forced me to get my head out of the sand. I have a fund of £10k but my income isn’t great at the moment so I need to be cautious. 

    Card 1 £12k- opened 2013, default Dec 2019. With Arrow, recent letter instructing Resolvecall to visit my home 

    Card 2 £15k - opened 2013, default Dec 2019. Link, last letter Jan 23

    Card 3 £7k - opened 2000, default Jan 2020. Moorcroft, last letter Aug 22

    Can I stop the resolvecall home visit? I could make them, or is it Arrow, a F&F offer. Or perhaps it would be better to offer small monthly payments? Should I request CCA before I do anything? What would you do about the other two debts? Initiate contact with a monthly payment plan or CCA request?

    CCA request first.

    Arrow own the debt, resolvecall are just a door knocking collector, you don`t need to deal with them, they can be ignored, there are plenty of threads on here about how to deal with companies such as resolvecall.

    They are just self employed collectors, not bailiffs, no powers whatsoever, write and remove there implied right of access, or simply ignore them, or tell them nicely to go away, they can`t do anything, if they call, just say your taking advice, or you will only deal with there client, film them, put them on you tube, really they are of little consequence.

    See what results the CCA requests yield.

    I didn’t know that about resolvecall.  They’ve just texted me about a visit so would it be as simple as replying that I’m dealing directly with Arrow and I don’t agree to a home visit? Thanks for all the help.

    Yes you can try that, but sometimes those numbers only work one way, and you can`t always reply to them, best in an email, or a letter, or, you can place a notice on your property, see below, this applies to anyone, debt collector/bailiff. next doors cat etc etc -

    "A debtor can remove right of implied access by displaying a notice at the entrance. This was endorsed by Lord Justice Donaldson in the case of Lambert v Roberts [1981] 72 Cr App R 223 - and placing such a notice is akin to a closed door but it also prevents a bailiff entering the garden or driveway, Knox v Anderton [1983] Crim LR 115 or R. v Leroy Roberts [2003] EWCA Crim 2753
    Debtors can also remove implied right of access to property by telling him to leave: Davis v Lisle [1936] 2 KB 434similarly, McArdle v Wallace [1964] 108 Sol Jo 483
    A bailiff must leave the premises when told to do so, Robson & Another v Hallett [1967] 2 QB 939
    A person having been told to leave is now under a duty to withdraw from the property with all due reasonable speed and failure to do so he is not thereafter acting in the execution of his duty and becomes a trespasser with any subsequent levy made being invalid and attracts a liability under a claim for damages, Morris v Beardmore [1980] 71 Cr App 256".

  • Hi, Wondering if I could get advice on how default dates are treated once a debt is sold on. I had a CC with MBNA that defaulted in April 2021, this was sold to Link Financial around August 2022. Looking at my credit report the MBNA card is marked a closed and the Link Financial one is open with a default date of August 2022?

    Should the April 2021 not carry over to Link Financial?

    Hi, Wondering if I could get advice on how default dates are treated once a debt is sold on. I had a CC with MBNA that defaulted in April 2021, this was sold to Link Financial around August 2022. Looking at my credit report the MBNA card is marked a closed and the Link Financial one is open with a default date of August 2022?

    Should the April 2021 not carry over to Link Financial?
    All of that is correct except the Link Financial default date should mirror the MBNA date of default, a debt can only default once, looks like they have got it wrong, a written complaint beckons.
