Hi, a quick question if I may.  I am now almost a year into starting my DMP, it took almost 6 months since cancelling direct debits and writing to the creditors for them to default my accounts.

I have a issue with a HSBC loan. I initially send a Holding Letter to them in November 2020, and in Feb 2021 I sent a offer letter with no response. So I decided to wait until they default me. And I am still waiting. Every 3 months they send me a letter that I am behind with repayments. duh. And if I don't contact them it may result in receiving a default notice (yes please).

What can I do to speed up the default notice? And can I ask them to backdate it to 2021?

I've started a dmp with stepchange this year and so far all my creditors have been really good at dealing with this except one Bamboo loans who have rejected the payment from stepchange twice now I also got a nasty sounding letter threatening attachment of earnings or charging order on my home but also saying they may terminate our agreement.

I'm hoping this is just there automatic response and they will pass the debt on to a more helpful company in future? Has anyone else had dealings with bamboo? This was a personal loan not a guarantor one.

    Thanks

They can`t do any of that without first obtaining a county court judgement, and the normal process is to send to debt collection, companies such as this like to ramp up the threat level first, just to make the unwary sweat a little, I wouldn't worry.

  • I am on a DMP with stepchange. Last budget review was about 9 months ago before the steep increase in the cost of living. Does anyone know where I could find an updated list of permitted within guidelines figures for food, fuel, clothes, hobbies, car maintenance etc for 2 adults, as I really think I need to amend my budget but don't want to put too high a figure for each in case they feel it is not justified and it causes issues. Thanks all.

You asked the wrong question, if your outgoings have gone up, then you adjust the monthly payment to your DMP accordingly, and then inform stepchange of what you have done.

You don`t go looking for their permission to live your life, you tell them what you can afford to pay, your budget is your budget, and everyone is feeling the pinch right now, be firm, they will be understanding, and you won`t have any "issues".

You put down what you need to spend, and no less, start paying them too much, then you will have issues when you can`t afford your essential bills, so don`t go down that road.

  • Sorry another question. I had a PayPal credit account that they say has been ‘charged off’. It’s been quite a while now and I’ve not heard from any 3rd party debt collector. I had a chat with PayPal live chat but they couldn’t tell me anything about it. Any advice on what I should do?

Just wait and see what happens, the live chat won`t know what`s happened to it, that`s way above their paygrade.

Charged off could mean written off ??? I`d say forget about it unless, or until someone writes to you.

  • Hi

I am approx 6 months into the process. I have some debts with dcas and some still with the original creditors and yet to default. When should I send CCA requests?

    Thanks

How old are your debts ?

Re-constituted agreements are quite easy to produce, its mainly old accounts that have been sold on a few times where correct paperwork can`t be provided.

Unless they are over 4 years old, I wouldn`t bother.
