    Hi, on my credit file it shows the original creditors of each default account and default dates, but also the DCAs that took over the debts with sometimes different default dates.  This means it is showing as 7 default accounts, but really there were only 4 and 3 are duplicates as they are from the DCAs records.  Is this correct or can I ask for some of them to be removed?  Which ones should I ask to be removed if this is the case?

    The original creditors entry, and the company that bought the debts entry, may both show on your file.
    They are just status updates of the same default.


    The OC`s entry should show the date of default, and a zero balance.


    The debt purchasing companies entry should show the same date of default, plus the outstanding balance.
    Accounts only default once, but the date of default for each account should be the same.

    So if they vary by any significant amount, make a complaint.

    I have noticed that the debt collection agencies entries have slightly earlier default dates than the original creditors on two of the entries.

    Should I complain to the creditors direct or via Experian/clearscore etc? I'm a bit loathed to get in contact with the creditors again, but if I'm able to get the dates changed I will. I'd rather they were gone a few months earlier if possible.

    You must dispute it direct with the lender.

    The CRA`s only process the information given to them, they are not able to correct or alter it, only the creditor that shared that information can do that.

    Essentially, and this is not an exhaustive list, the copy agreement must be legible, must contain your name and address, details of the borrowing, terms and conditions applicable at the time, etc etc.

    It does not require a signature to be present.

    There are websites that will check these for you, but you will have to use a search engine to find it, due to new forum rules I cannot post certain links.

    Thanks Sourcrates, it is in relation to a loan from 2016. They have sent me a copy of the loan statement for the first year & the fixed sum loan agreement, which details name, address & borrowing details. I think it's probably enforceable.

    There isn`t one that I know of, just simply tell them your intentions, its pretty basic.

    Somethings along the lines of -


    Dear Creditor,

    For the last (insert time) years/months (delete as necessary) I have been in a debt management plan run by (insert name of company) this has suited my needs up to this point, but having grown in confidence, I feel it is now time to take over management of my debts myself.

    With this in mind, I would be grateful if you could, by return of post, provide me with the necessary payment details and reference number of my account, so I can make payment to you.

    I enclose a copy of my most recent budget for your attention, payment will be £ (insert payment) paid on the (insert date) of every month, until further notice.

    I would ask that you continue to suspend interest on my account, so that I can repay my indebtedness to you all the quicker.

    OK so an account which was in default has now moved to 'in dispute' with Lowell according to Clearscore. This was definitely in default when I originally set my DMP up with Stepchange & now Lowell are saying unless I pay the £xxx a month they will default me. This amount is 3 times higher than the amount I was paying them through Stepchange. 

    Is it possible for them to re-default me?

    Have you checked the information on the 3 main CRA `s ?

    Accounts only default once, you only pay what is affordable, according to your budget, Lowell know this, everyone knows this, ignore their bluster, check the accounts status and if a complaint is required, then send one.
