  • Hi all - I’m about a year into my DMP now with payments set up with all of my creditors with the exception of Creation who I’m having a nightmare with causing all that old anxiety to resurface! Unfortunately I have 3 accounts with them. They’ve just issued a court claim for one which is making me feel ill - anyone have any experience of this?
    Also with regards to the other 2 they don’t seem to have handed them over to cca’s but continue to bombard me with letters and calls. I’ve sent lots of documentation but they keep asking for proof of income etc which I don’t want to provide in case they try to drive my payments up-any advice?

    Sorry, but I don't understand what you are saying.

    Why have you not included the three Creation accounts in your DMP?  
    Are you self-managing your DMP or have you got an agency such as StepChange to manage it all for you?

    When you say creation have issued a court claim, what do you mean exactly?  What does the letter say?

    I work within the voluntary sector, supporting vulnerable people to rebuild their lives.

    All a court claim does is ratify a regular payment, set by the court, in line with your budget, its not something to be feared, some creditors are just beyond dealing with, may as well let the process develop, and take the hit, it benefits you in that you don`t need to pay more than what the court has ruled, if those payments are too high, you can apply to the court to change them to something more affordable.

    People write that they are scared of court action, this is because they don`t understand the process, you don`t (normally) even enter a court room, its all done online and by post, any payment that is set too high can be changed.

    Under GDPR regulations you can specify how a creditor contacts you, write and tell them, you can refuse to fill in their forms as well, nothing is compulsory.

     I do wonder why Sourcrates and Willing2learn devote so much time to these pages - many repeats than are answered somewhere in the threads - but they are long threads and a big read - but then, if you need the help it's worth devoting the time 'cos thats all it costs.
    Can`t speak for W2L, but I suspect his reasons mirror mine somewhat, I got sick of reading post`s from people being bullied by banks and debt collectors, and decided to even the odd`s a bit more in the debtors favor, knowledge is power so the saying goes, ten years on, i`m still here.

    Does anybody else that every time you call HS8C they just postpone your default further. My loan and overdraft still havn't defaulted. Since April 19. It's really the only thing not going to plan on my DMP. So eventually it should sort itself out. 
    Isa help to buy: 1000/3000 33%
    Emergency fund: 100/1000 10%
    Weight loose 8.6 kg - while having fun. 0/8.6 0%
    Focus debt to clear HSBC £10/1111, 0% updated May 25

    Hi all I posted a while back and I am beginning my debt free journey, I have a lot of debt.  I have cancelled direct debits and am awaiting defaults then will set up a self managed DMP.  Anyhow I am now super stressing as I rent and have received notice that I need to leave my current property.  I know that I will be credit checked, my credit score is on the floor now and I have defaults, is the going to impact my checks, im worried I wont get anything.  Any advise appreciated

    All 5 CCAs have been sent, received, and signed for. I have contacted Payplan and closed my DMP so I am self managing from now on. (I only have 10 months left on the DMP). 2 with Link, 1 with Hoist, Sainsburys/Wescot, & Nationwide. All have defaulted and the last one drops from my CRA's this month.  
    I am stopping payment pending the CCA's but putting in a savings pot for potential F&Fs. I hope I am doing the right thing neutral

    I'm asking this on behalf of a friend who doesn't really do the internet.  
    They have set up a dmp with stepchange due to start this month.  They had a small emergency fund but have had a awful couple of weeks with everything going wrong. Unexpected car repair bill and a ill dog that needed treatment.
    I've suggested delaying starting the dmp by a month and starting next month instead but they are worried about upseting the creditors and stepchange.
    Is this feasible or a bad idea?

    Point number (1) Creditors do not get "upset", nor do Stepchange.

    Point number (2) Neither are your friends, your relationship with them is purely a business one.

    Point  number (3) Anything is possible, best to wait 6 months if they want too, save up an emergency fund, don`t rush into a DMP totally unprepared, its their DMP, no one else`s, don`t go looking for creditor approval to everything, that`s not the way to deal with them, you dictate the terms, not them.
