  • Hello, couple of years ago I sent a CCA request, PRA Group couldn't find my credit agreement and my account with them was frozen, few few weeks ago they started to phone me again as they apparently located the agreement. What should I do now? Should I sent another CCA to them, start paying or offer them 10%?

    Hi there. I think I did post on an earlier thread (not the one you're referring to), but things move at a pace sometimes on this forum and posts can get overlooked.

    Anyhoo....I don't know very much about Tax and NI matters, but glad that the HMRC are working with you/your hubby and giving you time to repay in instalments. I would see that as an additional expense that you would need to include in your I&E, but maybe worth having a chat with someone at StepChange who can help you with the process.

    The first thing you should be doing is asking them to provide said agreement if they can prove the debt is now enforceable then you could try an offer -but I rather doubt they'll accept 10% straight off the bat. Depending on the amount, you will probably have to barter a little. There is an F&F settlement thread on this forum, so you could pose the question there as well, but get the documentation first and also get it checked out with someone who knows what to look for. I've used the All About Debt forum for that in the past and they are very helpful folks over there.

    I think your best bet is to go back to Ferratum and get them to provide you with a statement showing the original balance and payments made. You should also have been provided with paperwork about the transfer/assignment of your debt to DRS - so pursue them for that as well. Then you can go back to DRS with your evidence and proof of the debt outstanding and go from there. You could of course insist that they (DRS) provide written proof of the debt transfer and balance.

They have provided the exact same paperwork as they did for mine but his covering letter said his debt remained unenforceable. Not sure what to think now. Both accounts were taken out online and the signature tock box is ticked. Has anyone come across this before? Not sure whether the incorrect covering letter has been sent or what! Thanks

    If you want to be really sure about your position regarding UEs you should go over to the All About Debt Forum. They have solicitors and other very knowledgeable folks who can confirm one way or another.
  • Hello you lovely lot!

    Today I received a letter asking me to repay my overdraft as my old bank are closing all of our (unused) accounts. When we made the decision to enter a DMP and switched banks, I 'tidied up' and ensured that the overdraft was clear. Therefore this account is at zero, has been since 22nd October, and has not been used since

    The bank are asking me to pay £48.56 comprising of £42.56 overdraft interest accrued but not yet applied and an additional £6 charge. The OD charges for that account are £6 flat rate on OD balances up to £100. This was never exceeded and I have no idea what this amount is for.

    I've been online, while I still have access, and have downloaded a PDF showing account activity from 1st October until today. This still shows a zero balance as of 22nd October when the last charge was taken. Am I correct in saying that any amount owed should be reflected in the most current statement?

    I'm keen to keep everything in writing but welcome any advice regarding what to say.

    I have just received a letter from 2 more accounts; one is enforceable but the other they have said they can't provide the paperwork so are not pursuing the debt at this time and the balance is £0 from £4200. Does this mean I just don't pay them? Don't want be too optimistic in case they find the paperwork. Thank you
