Accident insurance help

My son drove his car onto our drive and the neighbour reversed out and hit him. The neighbour is trying to blame my son. My sons car is damaged above rear wheel with damaged bodywork. The neighbours drive is at the side of our property. My son is a good driver and said he was driving onto our drive at the time and the neighbour hit his rear end. I got a quote as the neighbour would not admit liability and said he might pay half. Ive tried to be amicable. Now the neighbour is saying he won't as it admitting liability. Top and bottom of it its the neighbours fault however if I go through insurance because my son is a young driver it will hike his insurance more? Should I phone the police? Any advice as the neighbour is trying to get out of it. He had a van which overhangs the drive and its damaged my sons car. Because its a large van his is undamaged but the ladder on the back has damaged my sons car badly.

    Which vehicle(s) was/were actually moving at the time of impact?

    No, they're not the people who decide liability.

    He has a black box fitted. The damage is at the rear of my sons car not the front. My son was driving onto the drive and was reversed into side on.
  • In that case the telematics of the blackbox will back up your son’s version of events then. Report it to his insurers and let them deal with it then.

    Was the neighbour only just starting to move? Had your son only just turned in?

    If this goes to insurance, I can see this being 50/50.

    It's still not clear to me. How is the damage at the rear of his car if the neighbour reversed into his side?

    50:50 all day long I'm sure, because both parties dispute the course of events and both were moving. If your son is so sure of events, as debtdebt says, use your insurance and hope the black box vindicates him, although I can't see how it will. It might hike his insurance but it should do. He's had an accident in which he seems at least partly at fault.
