Atos assessor report - pip

Hi everyone i am new here :wave:. I am just wondering if anyone can give me some advice, reassurance re the medical assessors report for my new pip claim. I am really upset as he stated i was composed and mse was normal at all times. I showed o evidence of being anxious, upset etc and was not receiving any mental health support even though i told him i was awaiting appointments for referral back into intensive mental health support, i clean and walked to door with normal gait and didn't look underweight. He stated i did a physical examination, i did partly but nowhere near to the level of completion he has reported. Anyway long and shirt of it is he states i display no evidence of mental ill health, and that i have some difficulties with mobility. He has recommended my claim be reviewed in 2 years. Does this mean he is recommending i am awarded pip for two years or is that commemt unrelated to the final decision on whether i am awarded pip or not. Any info will be greatly appreciated

The assessor doesn't make the decision he sends his report to the DWP DM (decision maker), although tbh the DM usually goes off what the report says.

Thanks for your input. Am still a little confused. Sorry if i seem a bit stupid here. Is he recommending an award for the period of two years then on the basis of his report. I understand that you have said the Dwp makes the final decision😊0

What you also need to look at in that report are the boxes with either ticks or dots next to them. This is what the HCP will have recommended you score points in the descriptors, if any. A review in 2 years means nothing because they can recommend this whether any points have been recommended or not.0 -
.Thankyou for explaining that to me. He has ticked i have no functional restrictions which have been or will affect daily living activities but that i have functional restrictions which will affect mobility that will last at least nine months. I have been on dla for twenty years for severe mental ill health and many physical illnesses. He didn't report that i was tearful at times during assessment and anxious and neglected to report that my medication is kept by a friend when i am severely depressed and given to me on a daily basis, or that i have to have a friend take me out as too afraid to go out on my own. I can't believe he has left all of this information out!!. Looks like i am heading for mandatory reconsideration. ��.0

You will of course have to wait for the decision before the next step. If the decision goes with the report and it's rare to go against it then you'll have 28 days from the date of the decision to request the Mandatory Reconsideration (MR)

I feel totally sick that some assessors are totally okay with writing reports that are full of lies and omissions, it's peoples lives they are playing with. I am literally in shock having read what i have... And deeply hurt.0

It does happen unfortunately. A lot of people are also successful claiming first time or transferring from DLA, we just don't hear the stories very often because if someone is happy with their award, they have no questions to ask.
Did you send evidence to support your claim? They very rarely contact anyone for this and the onus is on you to make sure it's sent to support your claim.0 -

Unfortunately this is par for the course with PIP.
I have had five years and three face to face assessments and for each one of them ended up with 0 points.
For the first two failures I had to fight to get what I believed was my entitlement - Enhanced Care & Mobility. I received both at the MR stage. For the third refusal I just gave up as I felt that I could no longer put up with having to fight these decisions every other year for the rest of my life.
You must decide if you are fit enough and mentally alert to be able to challenge this decision all the way to a Tribunal hearing. If that seems like a mountain that you could not face then just give up - you won't be on your own - many are fed up with the constant 2/3 yearly reviews and face to face assessments.
If you are able to beat the DWP at their game then go for it. You will have a minimum 50/50 chance of winning at a Tribunal hearing.0
