Car I have bought has outstanding finance 😬

Hello Guys and Girls,

I have recently purchased a car that has outstanding finance from an independent one man band type trader. The previous owner is the original person named on the HP agreement. I brought the car as Spares or Repairs Due to the number of mechanical electrical and cosmetic issues which were present at the time of purchase. The trader provided me a HPI check which showed everything as clear. Where do I legally stand? I have provided black horse motor finance with all the evidence in relation to the purchase of the car and I am awaiting a response from them.

  • Don't worry about it, you bought it from a trader.
  • Unfortunately not as simple as that. After speaking with the "Trader" he apparently stopped trading 3 months before I purchased the car.

    So he bought the car to use personally and then sold it on and is named on the v5 as the previous keeper?

  • Nope he purchased the car as a "Trader" I had a copy of the receipt. The previous keeper sold it to a *MR Sponge Bob* of SB Car Sales Ltd. I don't obviously want to use sensitive information.... I purchased the car from SB Car Sales LTD as Spares or Repairs and after discovering it was on HP I contacted SB Car Sales LTD only to be told they knew nothing about it the HPI check they provided was correct at the time and they stopped trading in May I brought the car in August....

    So where did the HPI clear report come from?

    How do you know its on finance?
  • I originally bought the car with the intention of fixing it and my brother in law was going to purchase it at the total cost to me after all repairs were carried out. Unfortunately it has 4 seats which he didn't know and only found out once the car was purchased. All of this is documented in messages between me and the dealer. Subsequently I put the car up for sale to recover my costs and i was made an offer which marginally covered the cost and accepted. They did a HPI check and it showed up. The car is all registered in my name on my private insurance and me named on the tax. Sorry may be slightly more information then needed.

    And did this "trader" give you a receipt?

    The HPI check the trader provided would have had his trading name on it (evidence hes a trader).

    Did he present himself as a trader when you spoke to him / in messages / in his adverts?

    Has he any other cars for sale currently?

    Did you google his phone number?

    If you can prove any of this then he's still a trader and therefore is liable.

    Also, have you spoken to the finance company? It may well be that the finance marker simply hasnt been removed from HPI (not uncommon)
  • I have provided Black Horse motor finance with all the evidence I have. This included the original advert the HPI check the conversation between me and the trader aswell as pictures of the damage to the car. I Google searched the trader and the address it came up as the business had been liquidated in May 2018.
