    If you did a left or right turn on entering the bike park, odds on, wouldn't up the rear number plate.

  • Ok so I just appealed to POPLA on the basis that
    1) the entry and exit points with cameras are not the only ways a bike could access or egress from the site
    2) the bike was not parked in a parking bay, they have no proof as to where or even if it was parked
    3) the bike exited the site through the perimeter bollards and parked on a paved area next to, but physically outside, the site so Smart have no jurisdiction.
    4) the Astle Park website refers to CAR charges and lists a CAR parking tariff, no mention of motorcycles
    5) she has been going to the same gym and parking in the same place for well over a year with no issues, other bikes park in the same place as they chain up to the barriers - it is physically just outside the site perimeter.
    6) signage says that by parking you agree to the terms and conditions - yeah but she didn't park within the retail park so they can stick it where the sun don't shine!!


    It seems to my simple mind that any site that is not fully enclosed could never prove that a motorcycle or scooter stayed within its perimeter purely based on an entrance or exit camera. There is nothing to say you cannot use the internal roadways as a way through and out the other side (pushing the bike across the paved areas of course).

    I appealed on the basis that the scooter was not parked on the site controlled by Smart Parking and was not where they claimed it was. Making points about landowner authority or signs would only be relevant if it had been parked on their car park.


    I could not see a template relating to "it wasn't there Gov and you cant prove it was" - if I had then I would have used it


    You obviously know your way around this website very well and I can understand you experiencing some frustration with those of us who are new and ask the same questions time after time; but please understand that your average newcomer like myself struggles with it at first and knows nothing on this subject. Constant references to "look on the newbies thread" are actually unhelpful and likely to drive people away after they have struggled and confused themselves even more.

    What would help is to maybe offer a link to the thread ( or section of it) for us technophobes to click on, or improved search functionality maybe?


    Anyway, that said, - thanks for support / help / advise to all who have posted, it is appreciated - keep up the good work and please be patient with those less informed than yourselves
