Motorcycle parking

Hi, my better ½ got a parking ticket from Smart Parking Ltd on the Astle Retail Park in West Bromwich.
Her scooter was not parked on the car park but was on a separate bike parking area where they can be chained up (not sure if for cycles, motorcycles or both). The point is that you cant put a pay and display ticket on a bike and it was not taking up a parking bay or even on the car park. The first we knew was when the letter came through the post - it seems they have cameras on the entrance / exit that record number plates. She appealed to them on this basis but it was flat rejected.
Is this enforceable? I have never found a car park whereby bikes have to pay before

    What was the reason given for the 'ticket', not displaying a pay and display ticket, not parking in a bay or something else?
  • Not purchasing a ticket. They have cameras at the entrance and exit point and use plate readers to check against ticket purchase records. The bike was not parked in a parking space but was actually off the car park.
  • I too ride a bike (a proper bike not a scooter lol) and one thing is puzzling me, bikes only have a rear reg plate so I'm not sure how ANPR could capture images.


    Or if they can maybe only one image either entrance or exit NOT both am I right or wrong not sure but worth exploring I think

    Well I guess they could I just haven't seen any work that way. The car park scammers I'm currently dealing with have cameras that capture front number plate on entrance and rear plate on exit so wouldn't work with a bike, no capture on entrance.


    Surely worth OP checking pictures if only to rubbish my theory:D

    Well the Astle Retail Park, where the OP's incident took place, seems to show both the entry and exit cameras looking for rear number plates.

    See this GSV image for an ANPR camera on a pole at each end of the central island.

    OMG (not again...) she has rushed to appeal, and has blabbed about being the person who parked, hasn't she, and has thrown away the 100% winning appeal that she had as registered keeper.

    Whywhywhy do we see this everyday, this was a cinch to win.

    Now she will have to appeal to POPLA without the 100% winning point everyone else v Smart has (and she had, too, till she blabbed).

    But first she needs to complain to the retail park owners and/or a friendly Store Manager to cancel it on the spot (always exhaust the complaint, before POPLA).

    This is all covered in more detail, with complaint examples and POPLA examples, in the NEWBIES thread, where the 'registered keeper' appeal was that she should have used.

    I would check what the sign actually says. As you say, lots of places have separate areas for bikes. I just rode 1,500 miles around Scotland. Some car parks say motorcycles are free. Some don't.

    If it doesn't say it's free, then it's not free, and I'd assume they're in their rights to give you a ticket. I guess they'd argue if you can't secure a ticket to your bike, then you shouldn't be in your carpark. But as you say in this instance, they can cross check with the reg, and see you've not paid, regardless of whether the ticket was on the bike or not.

    Because, believe it or not, this site and advice is not as famous as you seem to think. In fact there are probably millions of people in this country who have never heard of this site and will follow the information given on the ticket.
