Pretty sure their NtKs dont have anything like POFA compliance....
  • Thanks. Is it correct to say in point 4 that in order to pursue the claim outside of POFA the Claimant would be making an assumption that the Registered Keeper was the driver?

    Hi all

My IP address has been blocked so haven't been able to access this forum on my computer.

I've sent our WS last week and am just finalising the SA to be posted today along with a letter to advise we won't be attending the hearing.

I just wanted to check if we need to send the Claimant notice of non attendance and copy of our SA? Will they be expected to send us this info?

    Many thanks

Yes, you must send to the Claimant, everything you send to the court.

Have you been copying and pasting into the forum direct from Word?

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I did copy and paste, hadn't realised this could cause problems. I've raised a support request last week but it still hasn't been rectified

Can anyone let me know how and when we can expect to learn the outcome of the hearing since we won't be attending?

    Many thanks

You will get an outcome from the Judge a couple of weeks later.

Not attending is risky. You will need VERY good evidence.

This does worry me Coupon-mad, but attending the hearing is just not an option. I figured hearing it on papers was better than just paying up.

I've done the best I can with the WS and SA and will just cross my fingers that it is enough to convince the judge. Whatever the outcome, I am most grateful to everyone who took the time to give me feedback and advice. Without it I wouldn't have bothered giving it a shot!

And your best is all you can do! I hope you have all the luck in the world and the Judge is clued up on how despicable scammers are.

Failing that and IF?? you were to lose don't take it too hard, pay as ordered by Judge and put the whole sorry state behind you also knowing that you've gained valuable knowledge in how to avoid crossing paths with the parking scum ever again (since I received my PCN I haven't drove in said car park, never will again either and tell EVERYBODY I know to avoid the place like the plague)
