NE parking Ticket Bond Street Carpark Blackpool

We have just picked our car up from this car park and have a ticket on the windscreen which states we were parked out with the marked bay. However when we arrived on Friday night the attendant told us where to park and asked us to pull our car forward (slightly over the white lines) to allow for taxis to pull into the electric chargers which were located next to our space.

When we noticed the ticket we spoke with the same attendant who phoned “the owner of this car park” and explained to him that he had asked us to park where we did.

Apparently they will cancel our ticket and the attendant told us to ignore any paperwork if it comes through.

Does this sound real or am I going to get taken to court for not paying?

Thanks in advance for your help

Nicky

Everyone is politely asked to read up on this in the newbies FAQ thread near the top of the forum before starting a new thread

Go there now to get an understanding of the game you are now caught up in

You are involved with an IPC company

See the FAQ on the likelihood on this being dealt with as you have been informed!!

Send off the template appeal in the FAQ if you get a ntk

Then ignore everything except a lbcca or Court correspondence

Come back for advice on how to defend this at the time if this arises

(Should you get confirmation they cancelled the PCN then hold on to it at least 6 years)

Crystal ball has the weekend off! Sounds a bit more 'real' than some of the situations we come across, but parking attendants do lie to avoid any confrontation, - only time will tell.

If they are going to purse you, you will know soon enough with a letter through the post between day 28 and day 56 following the date of the parking 'infringement'.

Time-wise, you're looking at 6-9 months before any court case is likely to happen - so a long way off, and not something to concern you right now.

It's a hopeless cause on a mobile. You need at least a tablet, or better, a laptop or PC.

Mobiles just aren't up to scratch for this so wait until you can get onto a proper pooter otherwise you will miss important stuff.

Read the NEWBIES and then send the template you will find there. Don't rely on or trust the PPC or the parking attendant. They don't make any money by cancelling PCNs.

Please do complain to your MP and the MP where the car park is located about this unregulated scam.

These are some of the comments made by the MPs in Parliament concerning the unregulated parking industry (Feb 2018):

    https://hansard.parliament.uk/commons/2018-02-02/debates/CC84AF5E-AC6E-4E14-81B1-066E6A892807/Parking(CodeOfPractice)Bill

''Rip-offs from car park Cowboys must stop''; unfair treatment; signage deliberately confusing to ensure a PCN is issued; ''years of abuse by rogue parking companies''; bloodsuckers; ''the current system of regulation is hopeless, like putting Dracula in charge of the blood-bank''; extortionate fines; rogue operators; ''sense of injustice''; unfair charges and notices; wilfully misleading; signage is a deliberate act to deceive or mislead; ''confusing signs are often deliberate, to trap innocent drivers''; unreasonable; a curse; harassing; operating in a disgusting way; appeals service is no guarantee of a fair hearing; loathed; outrageous scam; dodgy practice; outrageous abuse; unscrupulous practices; ''the British Parking Association is as much use as a multi-storey car park in the Gobi desert''; and finally, by way of unanimous conclusion: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists and ordinary residents should not have to put up with this''.

These are the exact words used, so you should quote them to your MP in a complaint and ask him/her to contact Sir Greg Knight MP if he/she wants further information about this scam.

arrived on Friday night the attendant told us where to park and asked us to pull our car forward (slightly over the white lines) to allow for taxis to pull into the electric chargers which were located next to our space.

This is called "estoppel" where the original contract was varied by a person assumed to have the responsibility to do so. NE Parking will argue they did not have the power but you leave that for a court to decide.

It is highly likely this one will go to court as they will deny you had that instruction and will not make the warden available to the court - so get that statement out to NE Parking as early as you can. Don't use a template ......

If a judge were to see that comment, he has to make a decision on who was lying. If you leave it to the last minute to produce it, they may decide it is you being untruthful so get it out front and centre as "estoppel".

Though you may think it was a scam, and everyone here would agree, express it in simpler terms and explain the background.
