car wrote off v5c not in my name yet

hi
my car was recently wrote off outside my work
ive claimed and its a write off
they need the mot and v5c form
i still havent recieved it off the previous owner and they claim that they sent it off ages ago and notified the dvla
ive applied for it myself now but how does it affect my claim
i told them i would be the registered owner when changing my insurance.
is it a case of it just taking longer to recieve the money as i have to wait for the v5c or can they now refuse to pay me?
very worried and very confused

  • How long is "ages ago". Think you're supposed to contact DVLA if it's not received within a few weeks?

    its a good few month ago
    i pushed them for it and they said they had sent it off and wrote them a additional 2 letters to inform them.
    if they do void it what happens to the car?
    should i just wait and contact the dvla and push them for the log book before i send them off?
  • have you filled in a v62 form and enclosed your green tear off section (v5c/2) that you were handed when you bought the car ?

    it states on it that the new keeper keeps it and not to return it to the dvla so never sent it as it states not to
    i enclosed a cover letter with the previous owners name and address etc so can they not check from there
  • umm , you are now going to have a delay ikt states on the green section , to fill in form v62 and TO ENCLOSE the section v5c/2

    if you hav,nt paid , then they will return it , if you have paid then they will write to last owner

    look at the v5c/2 , there is a doc ref number

    this is the same as the one on the front , however there are 1 extra digets at the beginning , for example , one in front of me says 36257 ,,,,,,,, and the v5 doc ref is 6257 ,,,,,,,,,,,,,,

    go to https://www.gov.uk/sold-bought-vehicle and fill in as the seller , enter your email towards the end , if it accepts the ref number from the green bit with the first digit missing , you will get a v5 within a few days , if it objects , then the transfer has gone thru or other fault

    without the green bit you have to pay 27 quid I think
  • thats fair enough but could take up to 6 weeks to sort out
    will my insurance be classed as void as im not officially the registered owner but i did own the car and ive simply been waiting like a idiot for the log book to arrive.so confused about it and its taking its toll on me now.the car was parked up and i was not in it and the other driver involved has admitted full responsibility for it and they are sending me a cheque in the next few days.is it simply a case of they will have to hold onto the car until i get the logbook and send it to them?
  • it will take 6 weeks if you have only sent in form v62 , if you do it on line as I suggest , it will take less than a week

    v62 = write to last owner to confirm it was sold , no reply within "x" days , then start to issue v5

    v5c/2 or online = immediate

    Will it affect my policy as im not claiming off my insurance company?
    i assume it only would if i was responsible for the accident?
    bottom line is can they refuse to pay out as the vehicles not in my name when it happened

  • you fill in the online form with the date you BOUGHT the car

    So if I do that and send it off then I would be covered on my policy.
