    Hi guys

just to give an update i have now received a notice of issue summons.(i am unable to upload a picture of the letter).

The letter states that they are instructing their client to instigate immediate legal proceedings against me. which can take the following actions

    1) Apply for a court order against your wages
    2) attach certain of your goods and property and have them sold in execution.
    3) Seek an order against you to attach monies that maybe due to you
    4) Obtain a court order for your examination
    5) Issue a statutory notice to have you declared bankrupt

This seems to be quite worrying. i am unsure what steps to take?
But you haven't told us who sent you that letter?

    Nobody can upload pictures here.
If you want to show us pictures, upload them to a free webhosting site and post a link to it here.
  • Hi i am based in London, i will re-read section 2 as there's quite a lot of info it does slightly get overwhelming
  • Apologies - thats a good question the third letter isnt signed off by anyone. It has a massive heading saying "NOTICE OF INTENTION TO INSTRUCT SOLICITORS TO ISSUE SUMMONS"

    Client; Private Parking Solutions

    Thats all

Ignore it. It is clearly a debt collectors letter.

Post #4 of the NEWBIES thread explains exactly how to deal with those.

What happened when the keeper complained to the Tesco manager/CEO?
If the driver didn't realise it was a disabled parking space then the signs must have been inadequate.

Have you complained to your MP yet about this unregulated scam.

  • A grace period is for reviewing the terms and conditions and accepting or declining them, the amount of times you post on this form I would have thought you new that, obviously not...

The signage does need to be clever though..
  • I would write to the CEO and say that you made an error, realised immediately and moved your car. In no way did you disadvantage a disabled customer.

Since then you have been threatened with the prospect of debt collectors turning up at your doorstep. Ask him if he thinks that this is the right way to go about treating customers?

A person who shops regularly in a supermarket may have an average spend of £5000.00 a year not including, petrol, clothes, Tesco direct etc. That over 10 years is £50,000. Can they afford to lose this custom?

If I ever get a parking notice from a company employed by a supermarket that I use regularly and they do not cancel it I would never give that supermarket any business again. They would be the bigger loser.

It sounds scary but the claim firstly has to go to court where it will be decided by a judge after you will have had chance to put forward your defence. It is only if you lose that you will have to pay the parking company. Providing that you pay with a certain time you will not incur a CCJ.

Can we ban the words 'what are the next steps?'!!

Hate that phrase, it's so simplistic. Posters are not children taking baby steps here on this forum. Whilst it is a game of strategy to beat parking firms, the 'next steps' question often drives us mad.

This is something that is fully covered by the NEWBIES thread and debt letters are there to be ignored. There is no need to ask what to do next, the sticky thread already tells you.

Come back at court claim stage have read everything you can, in preparation!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

That is not quite correct as other reasons for grace periods are allowed, but you are right that they don't apply in this case. I had forgotten that the BPA CoP does not allow grace periods for parking in disabled bays.
