Argos, return of office chair

Hi,

I replaced my office chair with one from Argos which was just shy of £100.

I have put it together and then discovered the protruding "headrest" part of the chair, is positioned right in the middle of my shoulder blades. This is extremely uncomfortable and within the hour was causing me upper back ache, and I don't suffer from back pain.

I have contacted Argos chat service and was told it can't be returned because its been opened.

Where do I stand on this? I want to return the chair to get a refund to look for another.

    I'd suggest taking it back to the store you bought it from to see what they say, and if they decline to refund perhaps try some more stores, their staff seem to have inconsistent responses to customer requests so you just need to find one that's happy to take it back.


    Or you could try to argue that it's not fit for purpose and claim your refund under CRA (2015).

    My argument is it's not fit for purpose. I've never had a chair which causes me so much back pain so quickly and is now actually causing me discomfort breathing.

    Okay either you are exaggerating a little or you need to go see a doctor, quickly...

    Its not unfit for purpose, it is a chair and you can sit on it.

    Is it adjustable in any way? It seems odd for a headrest to be so low it hits your shoulder blades, even for a very tall person!

    It seems there is a fashion of making mid back height chairs look full height.
    This would probably be fine for a 12 year old.

    The head rest is firmer at the bottom and when I sit back this presses on my spine a couple of inches below my shoulder blades causing the discomfort.
    Have you ever a gallbladder attack or punched hard in your back? It's very much like that. A intense dull pain in your back which radiates to tightness in the muscles across your chest and shoulders.
  • It's not an office chair, it's a gaming chair, so it may well be designed for a 12 year old!

    That said, you should be able to return it to the store without argument.

    From reading the reviews, the chair is advertised as having "tilt, swivel & lock mechanism" but doesn't actually have this feature.

    If that is correct then the goods are not as described and you should be able to return for a refund.

  • It's not fit for your purpose. You bought a gaming chair when you needed an office chair.

    I don't think that could be classed as a head rest given the size of chair, more of a shoulder/neck rest, especially when seeing the person in the video using it. I don't think you have any legal comeback with this.

    And as others have mentioned and clearly advertised, this is a gaming chair, not an office chair.

    Much as I enjoy my online retail therapy, I really think that something like a chair needs to be sat on and tested in-store before purchasing. Which doesn't make Argos the right place to buy from.
    No free lunch, and no free laptop ;)
