Carphone Warehouse Contract End Nightmare

Options
Hi,

Anybody had problems cancelling their Carphone contract on end on contract.

My 12 month contract ended 2 montsh ago but carphone warehouse kept it open, even though contract is 12 months, 02 paperwork is 12 month contract, every advisor who wanted me to upgrade said my contract had ended, plus sent a letter two months ago saying contract to end at 12 month point, which they say never received even though they received cashback request in same letter.

Received a bill this morning for month 14, even though on 12 month contract, girl was so rude, I had explained all the above but said she had not received letter and could not cancel on the phone, but to save me money send letter in to make my phone pay as you go then send another letter in to cancel which would save me another £80 per month or two months £160.

I had explained that I had cancelled my direct debits on the 12 month contract end, she said well the debt collectors will be around at myr door demanding the money.

I am going to fight this as terms of contract that I received when bought at time of phone never mention anything about when the contract ends. Even though the letter from o2 clearly states its a 12 month contract.

CPW said their t & c's clearl;y state 30 day written notice, amd I say thats ok, but I don't have that the only t&c i have are when I bought phone the deal offered, and it does not mention anything about when contract ends.

They are robbing b++tards, and they are going to have a fight on their hands. I have told them I will make them famous for all the wrong reasons, but they not bothered and said they have these same problems day in and day out, and nobody wins!!!

Anybody fought this sort of corruption and won?

cheers

Kevin

sorry, but you need to give 30 days notice in writing. they're not just going to cut your phone off without you requesting it to be done, hence the 30 days notice

    Hi,

But every piece of paper when buying the phone even the t & c when buying the phone does not mention the 30 days, it does not mention it at all.

Thats a point I am bringing with them that the contract i signed up for does not have the 30 day notice in it, so if there are 2 sets of t&c should i not get them or have I been misold.

    Cheers anyway

    Yes but with Orange....

I suspect the phone companies are desperate to keep business and have probably got targets to reduce churn as any loss of an account will show in sales figures. However if they think p**sing off a customer by being rude and obstructive is going to win them browney points... like you I was amazed at the attitude of the Oik on the end of the phone...

I started by calling and gave verbal instructions to terminate the contract. Like you I continued to receive bills even though I was not using the phone. After my second call I followed up with a recorded delivery letter asking them to confirm in writing that my account had been closed. Not even this stopped the bills coming.

I emailed them to advise I would not pay and if they continued sending me bills I would consider taking action against them for harassment. This seems to have done the trick, but have still not had the courtesey of a letter confirming the account has been closed.

IMO let them take you to court and advise you will counter sue for damages and costs.

    Good Luck

carphone are dreadful for cancellations. send off 30 days notice rcorded delivery or they'll say they didn't recieve it. you should have been informed by whoever you bought it from, so go back to the store and ask to see the manager. kick up a fuss (saturday would be good!) and ask for them to reimburse you.

It may be true, but I find it extremely hard to believe that your contract said that you had to give no notice.

Do you have a copy of your terms and conditions. If 'Yes' could you tell us what it says about 'Ending the contract'?

look, look at it this way. if you had a big business and took calls all the time and you're phone and number were hugely important to you and they disconnected your contract without telling you exactly 12 months to the day you took out the contract, you'd be annoyed wouldn't you. wouldn't you suggest it would have been reasonable for them to give you notice?

    hi,

bought from the web, terms of contract in phone package when arrived never mentioned a word about what happens at end.

i have no problem standing outside local carphone warehouse and telling people, and before they send debt collectors i will dispute the charges anyway, this is how they make their money.

I would have no objection if my t & c said i had to give 30 days notice but they don't.

Plus to make matters worse letter to cancel was in letter with cashback letter, got cashback but cancellaton letter not there, make your own conclusions but they said prove it, i am saying i can do no more than send the forms in post.

I will lose this because there solictors and budget is bigger than mine, but if i can stop one person buying from carphone warehouse then I will gain the moral victory.

PLEASE DON'T BUY FROM CARPHONE WAREHOUSE.

    cHEERS

If this is the case, you will win.

Again, I don't believe a word of it.
