Yes. See http://www.dti.gov.uk/consumers/fact-sheets/page38311.html and in particular this bit.
• For up to six years after purchase (five years from discovery in Scotland) purchasers can demand damages (which a court would equate to the cost of a repair or replacement).
• A purchaser who is a consumer, i.e. is not buying in the course of a business, can alternatively request a repair or replacement.
• If repair and replacement are not possible or too costly, then the consumer can seek a partial refund, if they have had some benefit from the good, or a full refund if the fault/s have meant they have enjoyed no benefit
I had a similar thing happen with a DVD recorder I bought from Argos. I got a partial refund and bought a better one than I had originally.0 -
Thanks for quick reply so should i write to the store or to head office or both3.6Kwh PV System, Lg Panels , Growatt Inverter South Facing, 23 deg Roof Facing, Stoke on Trent0

Head office.
ANE's information is spot on, but Comet stores think that they are above the law, so best to go straight to HO.
Let us know how you get on xGone ... or have I?0 -
I'd try sweet talking the manufacturer first, if you get someone nice in customer services, they might sort it out for you. If that doesn't work write to Comet, there are proforma SOGA letters on the web.
http://www.goodmans.co.uk/contactus.aspx?language=en-GBEver get the feeling you are wasting your time? :rolleyes:0 -
I should have added that Argos staff are as poorty trained as Comet's seem to be so I had to produce a printout of the web page I linked to and wait while they phoned head office. Only then did they comply with the law.0

Just to clarify, the first point of the 1st reply
"For up to six years after purchase (five years from discovery in Scotland) purchasers can demand damages (which a court would equate to the cost of a repair or replacement)."
Does not mean everything we buy is protected for 6 years. 6 years is the maximum, and it all depends on what the goods are, and it all depends whether the judge agrees with you that the item should have lasted xx months without fault.
A bunch of bananas, maybe 2 or 3 days
A cheap pair of flip flops, maybe 4 weeks
A really cheap and nasty bit of electronics like a small radio - I'd say 1 year.
Ant quality bit of electronics brandname TV microwave etc etc I'd put a minimum of 2 years and up to 6 years depending what it is.
Whether a judge would agree with me is anyones guess.
There are tiered fees applicable to the SCC depending on what monetary amount you are seeking. They are available here....
http://www.hmcourts-service.gov.uk/infoabout/fees/county.htm
Yeah, so if it is a small-small claim, the starting fee as you can see would be £35
Then you skip the allocation fee
and the listing fee does not apply to SCC
so the next fee (if it gets that far) would be a hearing fee of £25
The fees are paid by the defendant (retail outlet) if the plaintiff (customer) wins. No costs are generally awarded against plaintiff if you lose.0 -
If its outside of its waranty the manufacturer won't (and isn't obliged to) do anything for you - set your sights on the retailer.0
