Phone company have said that it is family fraud and a police matter and we have to deal with it. The account has been closed.
They have said they will not remove the markers off my credit history as they need a criminal prosecution of the person who acted fraudantly.0 -
They don't need prosecution - just proof that it is indeed fraud0

Just spoken to Vodafone they are saying there is no fraud as it was by a third party (9family member) who knew all the information.
The have closed the case and will not re-open and will also not take the black listing off despite the outstanding amount being paid.
I am so frustrated. Shall i go the ombudsman?0 -
You need to make an official written complaint to Vodafone before you can escalate to the FOS.I work within the voluntary sector, supporting vulnerable people to rebuild their lives.

It's still fraud regardless of who did it
The call centre staff don't know what they are talking about0 -
The money has been paid, account closed but still the black listing?0

Formal complaint and then report it to the ICO. They aren't allowed to register an account against your name when they know it wasn't you.0

- Make a report to ActionFraud and get a crime reference number
- Submit a Protective Registration with CIFAS
- Give the Crime Reference Number to Vodafone
- Ask Vodafone, in writing, to amend your credit file
- If Vodafone refuse, then make a written complaint
- If Vodafone don't uphold your complaint, then escalate to either the FOS or the ICO.

This is exactly what you need to do.
It is a difficult situation when family is involved, but this is only surefire way to ensure it is removed from your record. Action Fraud is a part of the police - if you are unwilling to report your family member to the police, then you are accepting full liability for the debt and all the black marks to your credit file that come with it.0
