If the other copy and paste is a defence , it should be headed DEFENCE before the first paragraph and end with a statement of truth at the bottom , the 2020 version , not the one you used !!

If this is still at CCBC stage , there is no court involved , any court would be the local one you nominate in your DQ , so unless you are sending this to your local court , which I doubt , it's going to be emailed to the CCBC in Northampton , which is a government office , not a Court

I sent the defence to the CCBC in 2018. The case must have been closed as I never heard anything until this month. It seems to have been reopened and the last letter was again to the CCBC for reopening the case.
I also copied the email to my MP. He has written back and wants to know what steps I would like him to take. Any suggestions as to what I should Reply with?

The CCBC seem to have unleashed a swathe of these two-year old, assumed discontinued cases. Whether this is by omission or commission is unknown at this stage. Please read the following thread by @inasanalias which nicely encapsulates the issue and contains a complaint to the CCBC drafted by forum stalwart @Coupon-mad. Use that as the basis for your complaint to the CCBC and cc your MP, asking for their help in resolving this nonsense. Sk them to also re your case to the MHLG the department responsible for drafting the upcoming National Code of Practice for reining in the excesses of this pernicious sector, leeching millions from the country's economy.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I have already written a complaint for people to send to the CCBC about these cases being resurrected with ZERO address checks or traces by the Claimants (allegedly).  It is in another 2018 thread last week by @inasanalias - exact same as your case.

You must all follow the court directions and deadlines as well though or you lose by default.

DQ must be done (see NEWBIES thread for how).

Ask if the MP will alert the MHCLG (quoting the new PAS232 Privately Managed Parking specification and new planned Code of Practice) and tell them that a constituent has alerted him that robo-claim solicitor, BW Legal have let 2018 claims go dormant, and are now resurrecting them two years later, and there is nothing to show that they have re-checked addresses. So every person is potentially heading for a default CCJ if they have moved in between, and some are even beyond the 6 year limitation.

Ask the MP to personally add comments, on behalf of beleaguered consumers, to these two consultations (as well as you):

Please now make a real difference - A TASK FOR SEPTEMBER.

The Government is (this month only) consulting about a new statutory code of practice (CoP) and framework to rein in the rogue parking firms.  Read and comment on the draft CoP proposal and the enforcement framework consultation, and get everyone you know to do the same.

You will need to register to comment on the CoP and enter an occupation even if you are retired or a homemaker, but otherwise it is easy to navigate, and comment upon each section/subsection individually. You can save comments to edit later and or submit comments once you are happy with them.

You do not need to register to comment on the enforcement framework which can be found here. It has a link on page 5 to make comments.

At the very least, we say the parking charge level should be £50/£25 or higher level £70/£35, as per Council PCNs in E&W.

And we say the added fake 'debt recovery' costs are just double counting the cost of letters, and MUST GO because that is unfair and illegal.

Please be heard.  You can bet the hundreds of PPCs will be commenting.

No apologies for repeating this vital 'call for action' to consumers, on every thread this month!

I have now received letter from BWL with all my defences  and their responses, pictures etc. It seems they have everything backed up to make all my defences useless. They are offering to decrease fine from £243 to £185. Do I still hold out and go to court or pay less now? What might happen in court?

They always try to devalue defences!  Did they say it was "from the Internet and was therefore worthless"?
