  • Thanks for the great advise again gents! i will send my response and keep you updated!

I have also received a response from my recently submitted defence from BW Legal stating their client wishes to continue with the claim and they have notified the court. They have enclosed a copy of the Directions Questionnaire. I expect i will be hearing from the Court again shortly.

Or even 'shouldn't have assumed'! Just a 'heads up' to avoid CM reading you the riot act.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

With a Claim Issue Date of 30th August, you have until Tuesday 18th September to do the Acknowledgement of Service, but there is nothing to be gained by delaying it.

Having done the AoS, you then have until 4pm on Tuesday 2nd October 2018 to file your Defence.

Loads of time, but don't leave it to the last minute.

When you are happy with the content, your Defence should be filed via email as described here:

    1) Print the Defence.
    2) Sign it and date it.
    3) Scan the signed document back in and save it as a pdf.
    4) Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    5) Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    6) Log into MCOL after a few days to see if the Claim is marked "defended". If not, you should chase the CCBC until it is.
    7) Wait for the Directions Questionnaire and come back here.

    Hi Keith/all,

The Directions Questionnaire has arrived and BW Legal have sent a copy of theirs earlier in the week. Seems straightforward enough but Is there anything I specifically need to avoid saying in my reply? Does this mean I will definitely be going to Court to defend the case?

    Thanks in advance

read post #2 of the NEWBIES FAQ sticky thread again, especially the BARGEPOLE link where he explains it all, get proactive instead of being wrong footed all the time

no it doesnt mean its going to court, just that one needs to be allocated

then the claimant must file the court fee if they wish to proceed further

and no more "assuming" , especially not for legal actions

Why not follow the guidance offered in post #2 of the NEWBIES FAQ sticky thread?

In there you will find Bargepole's walkthrough which tells you exactly how to answer every single question on the DQ.

When completed send the DQ to the CCBC using the same address and method that you used for your Defence.

Don't forget to send a copy of the completed form to the Claimant.
