    Sounds like a standard thing, anyone that buys within x distance of a petrol station would get a CYA report to say there "might" be environmental contamination because indeed there might be, at some point in the future, lets say a tank developed a leak. So they woudl be remiss not to warn about that.

    Odds are if its a small non branded station it will be sold and developed on anyway so that will go away. OTOH if there is space around it and its major it could be developed larger into a 24 hour cafe and shop etc, thats the way the industry is going. If i lived nearby would be more concerned about the latter than theoretical risk from a leak.
    Is it "Freds Independent Garage", or a BP/Costa/M&S brightly lit 24 hours operation ?

    Is a BP no 24 hours on it, it closes 10.30pm or 11.00pm some days. Have read the valuation report on it and already states on the report petrol station is next door and may adversely affect the property. The lender still passed the valuation and thr amount asked for on the sale.
    Is this basically a case of the solicitor covering their bum?
    Lots of may this maybe that relating to the report issue, and you may wish to get your own independent report etc.

    There is no space around it to develop as a retail business is right next door to it.

    No. The solicitor has received the environment report and will pass it on to you. Normal practice.



    If you plan to live there "forever" onward sale doesn't matter, if you did plan to sell sometime then since its value would be adversely affected that woudl be a factor, though no doubt that adverse affect is included in the price you are paying now.

    It is our forever home no interest in selling in future. Is a nice area where we are moving so I think the price factor has balanced itself out. As prob would be a lot less price if in a different area.

    Yes, in case they didn't want to lend if there was something concerning to the lender.
    To answer your initial Q, if the bank won't lend, first ascertain if this is just boilerplate or there has actually been contamination in the past. If the former appeal and if no luck find a broker who can find you a lender who will. I presume lender already knows it's next to a petrol station and commercial premises so as long as it's just boilerplate there seems to reason to expect them to reject, they ought to be used to this.

    They passed the valuation no problem and does state on there is next to petrol station so they are aware etc. We are signing the contract paperwork in the solicitors office on Tuesday.
