Gemini Parking Ticket

Good Evening,

During the Bank Holiday Monday, 27/08/2018, the driver took their kids to the soft play at the gym. While juggling to get the kids out the car, the driver used one of the gyms parking tickets that they had in the car (they had a booklet of paid tickets that they use for the gym) however it seems in the rush and chaos in getting out of the car one of their children knocked the ticket off the dash board which they did not realise and upon returning to the car they had received a ticket.

An appeal was made 2 days later via email advising that they actually had a valid parking ticket and provided a picture of the ticket along with the membership cards for their children for this gym however they received a rejected response although it states in the attached letter they had a valid ticket on display...

Lastly the actual owner of the car/registered keeper was not driving or parked the car.

Is there any way they can appeal this ticket any further?

    Of course there is, and you have already seen the way forward.
    You rightly masked the PoPLA code in their letter.
    An appeal to PoPLA is the way forward.

    Just to add the car is a leased car, does the circumstances change?
    Also, as we appealed by email two days after receiving the PCN, we have still not received a NTK letter.
    Should we be waiting for this prior to any further action or as I have responded to the PCN via email and had a response with the POPLA code, I am ok to directly proceed with appealing to POPLA?
    I worry if the NTK goes to the lease company, they will end up paying for the PCN and charge me the full cost and their commission...

    Writing on the sign is illegible, and so there was no contract agreed.

    Usual templates from the NEWBIES thread, third post, put them together.

    Shame that possibly the driver was admitted? Maybe not in fact?

    Did the appeal say ''we did this'' which will mean the driver was not admitted?

    Should not have rushed to appeal 2 days later. Shouldn't have even appealed yet, and should have used the template from the NEWBIES thread on day 26. NEXT TIME!

    The following was the appeal via email

    Subject - Reference of PCN

    Good Afternoon,

    As per attached picture of proof of parking ticket and membership, we believe this ticket has been issued wrongly.

    Please can this ticket be waived off your system.

    Do what? You appealed in the first name of the DRIVER? Do you mean the HIRER?

    The email was sent by myself and the email response was with my first name, not in the hirers name...
    As the lease company is the registered keeper, does this change anything?
    I will get my wife to inform the hire company today to make sure any tickets received are not paid for

    Apologies for my ignorance, the letter was sent to my full name although I sent my appeal via email with just my first name.
    They are assuming my email address (which is my full name) is actually my full name.

    The registered keeper is the lease company and the car is leased in my wifes name.

    So you were the driver, you appealed (gaaaah, should have been the hirer who appealed!) and in doing so, you have ruined the 100% winning position your wife had. And you can't rewind it.

    Again. Sooo frustrating.

    Search the forum for blabbed POPLA as your keywords to try to rescue this.

    I did not appeal as the driver I just sent a blanket appeal from my email address.
    I did not mention who was driving, does this change things?
