Court claim form

Hello,

hoping somebody can give me some advice! Have read the newbies thread and advised me to post immediately if received a court claim form so here I am!

I am a training surgeon who works 1 weekend on-call at a hospital in the North of England as they find it hard to recruit staff so I help out. I am not required to be in the hospital at all times and go in when theres an emergency. Because I only work 1 weekend a month the trust won't give me a permit and their answer is to just put money in a meter. Obviously when I'm attending an emergency I do not take time out to get change/get a ticket etc etc. Anyway, this has resulted in me receiving several fines which I have (stupidly) totally ignored from UK parking control ltd.

Now I have the N1 county court claim form from just under £1200.

I am also classed as a full time student if that makes any difference at all.

I saw on the threads of many cases that can still be overturned at this stage. Would anyone be willing to give me some advice?

Thank you in advance.

  • Hello, yes there will be plenty of good people who will guide you through this, they know their stuff, follow their advice and you can put this to bed (eventually)

I would have thought you would have a strong case with the NHS trust your working for though? they would have the power to squash these "INVOICES" and if you do end up in court i cant imagine any Judge looking too favourably on UK parking with your circumstances.

Do a bit of reading on here (sure your used to that with your job) and let thind take their natural course.

Is this the Cumberland. AFAIK they are being removed so this may be a revenge claim. Have you informed the Trust and ask if their contract allows them to cancel?

Yeah I have been in touch and apparently once it goes beyond the parking notice they can no longer do anything? Ridiculous I know!

Do you think it is worth including the situation when modifying the standard defence on here?

Same sort of thing as this case:

Why not send a pm to that OP and assist and give support to each other?

The advice on that thread applies to you as well, you will need evidence for later on, but for now you need to firstly, submit an AOS online as per the NEWBIES thread and then show us a draft defence.

Here is a decent NHS defence template to edit, written by forum expert bargepole:

Yes you should add words to that defence, that say that UKPC were predatory, aggressive and have now been kicked off the site and why (and get evidence from your HR or Facilities Manager for later production at pre-hearing WS stage).

Perhaps the hospital's 'facilities management' need reminding of this short extract from The NHS patient, visitor and staff car parking principles:
    Contracted-out car parking

NHS organisations are responsible for the actions of private contractors who run car parks on their behalf.
