number of confusion factors for appeal

hello all.


After reading all the newbie thread I am still a little confused on wording my appeal. if I explane all the factors around the situation hopfully some one can point me in the right direction.


It's a company van
entered a ANPR service station in the morning and left within 5 minutes.
entered the same ANPR service station later that day and again left within 5 minuets. (this is due to being able to leave the services and join A roads.
this week the company received a letter from EQUITA saying Parkingeye limited have passed a outstanding debt on to them to collect.
the company never received any letters from parkingeye and also the postcode on the EQUITA letter was incorrect (might explain why we didn't receive the parkingeye letter)
The charge is from 15/03/18 but only just hearing of it now
The van I tracked and I have the evidence it was not parked on the service carpak for the time it is accused of being.


What information should I give them and how would I word all that in a appeal? any guidance would be greatly appreciated.

  • I think this is known as "Double dipping" and there are many threads on here related to that.


    Search around for that term and then look at response to that.


    having tracked evidence I feel will be very useful and if you follow the advice here you can these off your back.


    You are also advised NEVER to identify the driver in ANY PCN so I suggest you edit your post accordingly.

    Looks like a bit of a twist on double dipping based on this.
    entered the same ANPR service station later that day and again left within 5 minuets. (this is due to being able to leave the services and join A roads.

    Triggered the cameras going in but leaving by the back entrance to the services by the looks of things so no corresponding capture of the vehicle leaving.

    thanks for the replies.
    just having a look at Double dipping now, very helpful. the services is well known for cutting through in the area. it has a hotel on one side so lots of people jump on and off there and their is cameras on every entrance/exit.

    Interesting. Assuming that the entrance to the services from the back roads is not covered by ANPR, if you then exited the services onto the motorway in the morning and returned in the opposite direction in the evening (again, assuming from the same side of the motorway) and through the ANPR into the services but out through the back roads, the times on the ANPR would show the vehicle travelling in the wrong direction. ie., leaving the car park area in the morning and returning in the evening INTO the car park area.

    Would be interesting to see the ANPR pictures and timestamps and direction of travel in relation to the car parking area.

    Still, should be able to get this quashed one way or another if you follow the advice and no keeper liability anyway.

    Email PE:

    enforcement@parkingeye.co.uk

    with the xxxxxx/xxxxxx PCN number in the subject line.

    And explain that the driver entered the site twice (go into more detail but no naming the driver). Tell PE they have got the postcode wrong and maybe that explains why no letters have arrived at all before this one and as such, your company requires:

    - a proper check by a human, to find the double entry/exit (give approx times) and then they must apologise, and cancel.

    - a POPLA code if the PCN is not cancelled

    - the company address to be corrected to the correct postcode

    - an explanation of how the address error occurred and where that data came from*




    *I would ask this even if you think you know. DVLA? Lease firm? Important to know for sure, for POPLA stage, as lease cases are dead easy to win.

    Would you recommend adding that to the newbie template or sending it as a initial correspondence? at this stage would it also be beneficial to attach a pdf of the Equita letter with the wrong address along with the tracker information. the tracker info is only laid out as a location to and from text with times as the date is to old for a map view.

    No template in this case. Often with ParkingEye cases, I suggest NO TEMPLATE.

    Yes you should attach the info you have. They SHOULD cancel it.

    Hello.


    We recently received a parking fine notification from Equita on your behalf. This letter was the first correspondence we have received from your self and/or Equita regarding this matter. The letter from Equita has the wrong postcode on the address and maybe this is why we have not received any initial letters. With regard to the charge its self, on the date accused the vehicle entered and exited the site in question twice (once in the morning and once later that day) but not exciding the allowed time. The vehicle is tracked and we attach a PDF copy of the telematics for the date and times required. As such the company request a proper check by a human, to find the double entry/exit times (this will be within minuets of the proposed entry/exit times) once your mistake has been acknowledged we require the parking charge to be cancelled.


    we advise that the incorrect address be changed to the correct one and we ask for a explanation as to why the error occurred and where that data came from? if the charge is not cancelled we will require a POPLA code.


    Please find attached the PDF containing the vehicle tracker information and a copy of the Equita letter with the incorrect address highlighted.
