Private parking notice

I received a parking charge notice using anpr cameras saying the driver didn’t pay for parking. Fortunately out of habit the driver had taken a picture of the ticket and appealed to Smart Parking showing the ticket having paid for 2 hours parking from 10.15 - 12.15. The ANPR camera clocked the vehicle entering at 10:12:47 and leaving at 11:50:37 so 97 minutes against 120 minutes paid for.
Smart Parking have rejected my appeal and I now need to appeal to Popla, what an absolute joke. I’ve now appealed to Popla and the Smart Parking have fed their comments saying the driver didn’t pay for the correct time - surely they must allow a grace period to park, go and get a ticket and put in your dashboard. I can’t believe the cheek of them.
Has anyone else had this issue before?

    so much so that grace periods are covered in clause 13 of the BPA CoP (have to read it ?)

    there are 2 grace periods for this, one before and one after parking , plus I am not sure how grace periods are relevant if the driver exited the car park within the paid for time ?

    perhaps the machine didnt take all the money and maybe only one hour was paid for ? check the ticket as its your receipt and contract for the payment , then check what their NTK says, also check if the correct VRM was entered for the paid for ticket, because this is a common area for mustakes

    I assume you have one week to give popla your comments ? ( a rebuttal )


    ps:- the ANPR camera does not clock people , it logs the VRM of the vehicle going in and out of the car park

    I have a different problem with Smart Parking.. they clocked me in when I dropped my child off and clocked me out five hours later, although I had left and gone back five hours later. They are a joke

    ANPR errors, well documented and knows as "double dipping" (google it)

    Tone21, you need to edit your post to remove all clues to the driver's identity.

    Perhaps your post should look something like:

    There must be some procedure that you needed to go through to tie up the ticket with the ANPR camera - e.g. keying your Registration number when you bought the ticket.

    Please supply details on this. If you didn't follow their procedure, then you need to show why you missed it.

    does the ticket purchased cover the 2 hour period with the correct amount on it that matches the signage ?

    does the same ticket have the exact and correct VRM details as the vehicle being used (all of the correct VRM, not just a partial ?)

    you are allowed say 10 minutes to enter and purchase a ticket after reading the signs , and over 10 minutes to leave, ON TOP of the paid for charge

    look to see if any errors or mistakes have crept in , how long are smart saying was paid for, and therefore how long are they saying was unpaid ?

    that may be why they allege the period wasnt paid for

    ie:- a faulty machine (a common problem) , which is what we are trying to get to the bottom of

    so this would be one of the comments you make, that the ticket machine was faulty and would not allow the full VRM to be used so the digits were used to identify the VRM plate


    its not your fault if the machine cannot verify the plate, its a frustration of contract

    You are missing the point completely. It is explained a bit in the replies following yours, but to make it simple, the PPC needs to have some way of tieing up a ticket to a vehicle and that is usually by entering the vehicle's registration at time of purchase.

    I suspect that the answer lies in Redx post above.
