"if they had proper ventilation".... and what other rules/regs/laws have they broken? You don't know the extent of the liability they might be putting onto your shoulders if they have such scant regard for the law.

Remember the gas explosion in Leicester that demolished a shop and the living accomodation above it earlier this year?
What would happen - where would you live - if they had a gas leak and the resulting explosion demolished the entire building or made it unsafe and unusable?
Extreme situation, yes but it could happen.
You need to report it now.
Another consideration to think about is would it invalidate the buildings insurance?0 -
Plus, if they are an unlicensed takeaway business, they could be poisoning people but that's not your problem, is it? The council might want to know, though.0

Short term:
If they are subverting building regs. chances are they are cutting corners elsewhere. The main concern would be fire safety. Fire is much more likely to happen in a kitchen, than in a graphic designer's studio. And i highly doubt the owners of the take away have taken all the necessary precautions to mitigate the increased risk.
Then there is hygiene and the potential to attract pests. Nuisance, if they decide to stay open till late.
Long term:
Some surveyors might undervalue your property in the future due to the take away business down stairs. This might impact the sell-ability of your property, even if you are not bothered by anything else but the smell.0 -
So I’ve reported it to the council and management company. I’m waiting for the council to look into it. The management company are dealing direct. I just want the smell to go0
