you are going to look a right numpty in court when you talk about CCTV and they say they do not use CCTV , they use ANPR real time monitoring instead
its not our fault that you do not know the difference between the two
frankly , I am sick of arguing with you so will bow out
I have no doubt that their reply to your SAR for CCTV footage will be met with a "we do not have any CCTV footage at all so cannot supply it" answer

I accept I will probably be laughed out of court and have to pay a couple of hundred pounds for absolutely no reason but I have to at least register my voice against these low life crooks you live and learn and i am learning still !

You have a point but what you need to do is the following
1. Understand the court process. This means in the next 4 weeks you have to acknowledge the claim and send in a defence
2. If you do not acknowledge (which takes 2 minutes to do) you get a default CCJ. Acknowledging within 19 days of the date on the claim form gives you an additional 14 days.
3. If you do not defend within 33 days of the date you get a default CCJ
4. There are templates to use which will give you a guide to what is said in an initial defence. You should concentrate on the fact it was dark and no reasonable person could have seen the signs.
5. Once you have done all of the above, you send a Subject Access Request to HX who will supply copies of the paperwork they claim to have sent, photos of the car and pics of the signs. Ask for any CCTV images too pointing out that they claim to monitor car parks in real time. You will get these within 30 days but too late to include in a defence.
6. When the next paperwork arrives, come back for advice. The court process is used by HX to grind people down as there are 4 - 6 stages that need to be dealt with. It will be unfamiliar to you - but not to us.
For the others .....HX do use CCTV as do a number of other PPCs, especially Comprehensive Management Services. Have a look for the HX installation at the Shell garage at Satterthwaite(?) to see. How they get the images is immaterial to the DVLA as all they want is confirmation of the car plus VRM in a time stamped image

The use of CCTV by HX gives you an advanage as the images are rarely good enough to show the signs so you can challenge whether the copies they include in their court park are the real ones - as often they are not. You challenge whether the wording could be seen. Their poor evidence (using CCTV) kills most of their claims - but they are not interested in winning as most people fold when seeing these grainy images that are not of evidential quality.This is a system account and does not represent a real person.
