Parking Ticket at my Residence

I woke up on Saturday morning to find a parking ticket affixed to the windscreen of my vehicle. I had a resident permit displayed on the corner of windscreen albeit slightly obstructed by my work parking permit but the vehicle details and permit valid dates are visible. I immediately fired an email to P4Parking stating that I am a resident in one of the apartments and attaching a copy of my valid permit, I asked that the ticket be cancelled as I had the permit displayed in my vehicle. I received a rejection letter from them on Monday alongside a Popla code by email.

Should I appeal straightaway?

Any help with the draft for the appeal would be sincerely appreciated?

    Do you have an allocated bay which is set out in your lease/AST?

    Do the residents own the freehold of the block. Is there a Managing Agent?

    I will leave the appeal side to those better versed but it can be possible to get the ticket squashed at your end.

    As others have said elsewhere the lease is really the key document. If you are a tenant you might have to see if your landlord will let you have sight of their copy. You are looking for anything about parking (are permits mentioned) and any catch all paragraph about introducing changes they see fit for the good running of the estate.

    Moving on - on what authority were P4P introduced to the development and who is party to the contract with them

    I am renting my apartment through an agent and the landlord is not resident in the UK.

    I have spoken to the development management but to no avail.

    I have disclosed my name to them on my initial appeal.

    Should I appeal to Popla or ignore them?

    I am a tenant in the property and there is no mention of parking in my AST, but I was told told verbally by the agent that I can obtain parking permit from the concierge/managment on a continuous basis as a resident, which I have always done. The development has about 40 "Visitors" car parking space which are used mostly by residents.
  • The right to use the space belongs to the landowner. However, they might have demised the right to use the space to a leaseholder (your landlord). If that is the case then in order to park you need permission from your landlord only. That would mean you don't need to display a permit obtained from a management company since they cannot grant you the right to park.

    The estate agent is unlikely to have seen the lease and I wouldn't trust what they tell you.

    It does ask depend on the wording of the various contracts that flow from the landowner down to you.

    OK, so was parking advertised with the property? Are you sure there is nothing about useof communal spaces?

    Yes I park in one of the communal visitor places.
