Easier said than done. I have an apartment in an HA development. I have never met a more useless apothetic group of people in my life.You never know how far you can go until you go too far.0 -

My car park also has an electric gate that you need a fob to pass.you said you owned the space, in which case its nothing to do with the HAeither you own it , or you dont , I am assuming you lease it and do not actually own it ?plenty of these cases have been won in court by residents, but be sure of what you say and what you own or pay for1 -
If the block is owned by a HA it is unlikely that you own the parking space, usually thes belong to the HA. What do your deeds say?

Having double-checked the lease, I fear you may be correct. The space was included when I bought the flat eight years ago and I've used the parking space ever since - haven't ever had to pay for a permit, it was always included. However, the space isn't mentioned in my lease. I have reached out to my HA.
I am now concerned that I've dropped the ball and should have paid the fine? Presumably this strongly weakens my position if it were to go to court. Any advice?0 -

It was never a fine and it is most likely it was unlawful. As a resident it is likely that you are in a far stronger position than the con artists who are trying to scam you. You need to revisit the rules of hardball. IT IS A SCAM.You never know how far you can go until you go too far.1 -

Hi there. I own a freehold house with a leasehold parking space. The parking space is not mentioned in my house deeds. Is it possible the car park space you have used is mentioned elsewhere (in another document) because you have used it for 8 years and it would appear have some right over it. My car park lease was actually mentioned in a Wandsworth planning application and it was a eureka moment when I found it as the developer wanted to charge me (a lot) or prosecute me for trespass!0 -
and it may well be that you would not have bought the apartment in the first place if there was no right to park1
