Britannia Parking - Have ignored all previous communications. Have proof I paid.

    As per advise I have drafted an e-mail to both BW & Brit Parking:

    Dear Sir/Madam,

    I write to both BW Legal & Britannia Parking with reference to account number xxxxxx where I am alleged to have parked at the DEX MSCP car park in Newcastle upon Tyne and failed to validate my stay on the 25th of September 2017.

    I believe this claim to be incorrect and do not appreciate the harassment by Britannia Parking, Debt Recovery Plus, Zenith and now BW Legal which has caused me a lot of unnecessary stress. The attached image clearly shows I have a payment on my debit card statement made to Britannia parking on the date of the alleged offence. This payment was made using the pay by phone mobile app which uses a location number given to each car park to make payments easy and accurate. I have attached a screen capture of this transaction, it clearly shows the amount of £4.80 was debited from my account on 26/09/17 for a payment made on 25/09/17.

    I feel a judge would see this as sufficient evidence if this case were to go court as the bank statement clearly shows I have made the payment required. If the judge were to rule in my favour I would seek a payment to cover both my travel costs as well as expense and loss of earnings. These would dwarf the £160 in question. Taking everything into account I request that this case be dropped against me and I am no longer harassed by either BW Legal or Britannia Parking.

    I request you decision whether or not to drop this case in writing.

    Does this look okay? Is there more detail to be added or have should I take certain parts out?

    A couple of points, BWLegal cannot claim £160, the £60
    is a fake debt collectors add-on. BWLegal must think people
    are stupid when it's actually BWLegal who are stupid

    Cost are limited in county court which mostly are up
    to £90 so don't go threatening this. COSTS WILL SUFFICE

    IGNORE everything except an LBA whereby BWLegal
    must comply with the law and offer proof of their claim,
    all costs (not fake add-ons) and give you 30 days to
    respond.

    If you get one of these come back here

    I assume you have read up about BWLegal and their
    claims that fall flat in court and they get whooped.

    In essence, all their claims are much the same so you
    can learn from this

    Taking everything into account I require that this unfair charge is cancelled by your client and I expect an apology from Britannia Parking, as well as an assurance that they have made a correction under the GDPR 'Right to rectification' to put right the incorrect data held.

    Failure to correctly update their records - and then delete my data which cannot lawfully be held without reasonable cause - will result in a formal complaint being made to the DVLA and to the Information Commissioner, about your client, for breach of the DPA.

    Your client has one calendar month to respond to a request for rectification, and of course being a firm of solicitors whose first duty in litigation is to the court, I trust you will handle this within the required timescale and ensure that no court claim is issued.

    OP, when I said change your username, I did say 'to something more anonymous'.

    For some unknown reason you have changed it to something that will be easily recognisable by the parking company that are pursuing you.

    Using you initials, as evidenced in post #12 above, and the town/city where the parking event took place, can be seen in your opening post, pretty much identifies you.*

    That was a silly idea.

    I have an outstanding case with Britannia Parking dating back to Sept of last year. They claim that I did not validate my stay. When I originally received the PCN I ignored it (I know, I know) as I thought this was the best option.

    Of course as you will all know this then escalated to the Debt Recovery and BW Legal to name a few. I have today received a court claim from from Northampton Court on behalf of BW Legal who are representing BP. The total outstanding balance they say I owe is now £242.78 as there is now court fees etc included.

    As previously mentioned I have a bank statement which shows the payment for my parking leaving my account using the pay by phone app.

    What are my options here. Should I just pay up and put this to bed or do I have a case. I know I shouldn't have ignored originally but this is the situation I am in. I am looking to move house next year so don't want a footprint on my credit file.

    All help/advice appreciated.

    Of course you have a case, you paid and can prove it.

    What did they do with the money you paid ..... put in their back pocket so to speak.

    The claim is false as they have added fake money.

    Why do people with court claims ask if they should pay? NO.

    You know to check the NEWBIES thread and what to do, and that's using MCOL, do the AOS, then draft a defence.
